Consumer Narrative

This is a formal complaint against EXPERIAN for its continued failure to comply with the Fair Credit Reporting Act ( FCRA ), specifically 607 ( b ), 609 ( a ), 611 ( a ), and 623 ( a ) ( 1 ) ( A ), as well as violations of the automatic stay provision under 11 U.S. Code 362 of the United States Bankruptcy Code. Despite being discharged in XXXX XXXX bankruptcy ( XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XX/XX/XXXX ), EXPERIAN is unlawfully reporting accounts that were included in the bankruptcy as delinquent or with a {$0.00} balance while continuing to show negative payment history. These include : XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX. Reporting these accounts post-discharge in this manner constitutes willful and negligent violations of both the FCRA and the bankruptcy automatic stay. Furthermore, EXPERIAN has failed to maintain reasonable procedures to ensure maximum possible accuracy of the information being reported, as required by FCRA 607 ( b ). By continuing to furnish and display discharged debts without properly coding them as " included in bankruptcy '' and discharged, EXPERIAN is furnishing misleading and inaccurate information to third parties. This has resulted in significant reputational and financial harm. Moreover, under FCRA 609 ( a ), I am exercising my right to request the name and contact information of the third-party vendor or furnisher that provided the bankruptcy data currently appearing on my credit report. To my knowledge, the U.S. Bankruptcy Court does not have a direct relationship with any credit reporting agency, nor does it supply data to such agencies voluntarily or automatically. I demand the immediate deletion of the above-referenced tradelines from my credit report and for EXPERIAN to cease reporting outdated, inaccurate, and legally discharged information in violation of federal law. Failure to act on this complaint will result in further escalation to the Federal Trade Commission, my State Attorney General, and possible civil litigation under 15 U.S. Code 1681n and 1681o. I also demand written confirmation of the actions taken in response to this complaint.
