Consumer Narrative
I am submitting this complaint regarding the following account, which appears on my clients credit report and remains unmarked as disputed by consumer, despite a formal dispute being filed : Creditor : XXXX XXXX Account Number : XXXX Legal Grounds Under the Fair Credit Reporting Act ( FCRA ) : 15 U.S.C. 1681s-2 ( a ) ( 3 ) : Furnishers of information must notify credit reporting agencies ( CRAs ) when a consumer disputes information on their account. 15 U.S.C. 1681e ( b ) : Credit reporting agencies must follow reasonable procedures to ensure maximum possible accuracy in consumer reports which includes properly reflecting dispute notations. 15 U.S.C. 1681i ( a ) : Requires CRAs to conduct a reasonable reinvestigation when a dispute is submitted. While this dispute is under reinvestigation and even after, if the accuracy is still in question the account must be clearly marked as disputed by consumer. Omitting this notation is misleading and renders the report inaccurate under the FCRA. Specific Violation : The XXXX XXXX account was formally disputed. However, the account was never marked as disputed on the credit report. This failure misrepresents the status of the account and creates the false impression that the consumer agrees with the negative reporting. Courts have held that such omissions constitute inaccurate and misleading information under the FCRA. Supporting Case Law : XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX ( XXXX XXXX. XXXX ) : A credit report is inaccurate if it fails to reflect that a consumer disputes an account. XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXXXXXX ( XXXX XXXX XXXXXXXX ) : The failure to report a known dispute is materially misleading and a violation of the FCRAs duty of accuracy.
