Consumer Narrative
I am writing to formally lodge a complaint against Jefferson Capital Systems and Credit Collection Services for reporting false information to my credit report without my authorization. The accounts in question are charged-offs, which should not be reported as income on my credit report. According to the Fair Credit Reporting Act ( FCRA ), 15 USC 1681 section 602, consumer reporting agencies must act with fairness and respect for consumers privacy rights. As a consumer, I have the right to ensure that my private information is not shared without my consent, as supported by 15 USC 6801, which mandates financial institutions to protect the privacy of consumers nonpublic personal information. Furthermore, 15 USC 1681 section 604 clearly states that consumer reporting agencies may only furnish reports according to the written instructions of the consumer. I have not provided such consent, in any form, to XXXX, XXXX or XXXX to share my information. All prior consents are hereby revoked. Additionally, the reporting of these charged-off accounts contradicts 15 USC 1681c ( a ) ( 5 ), which prohibits consumer reporting agencies from including adverse items of information beyond the legally permissible timeframe. The original accounts, categorized as charged-offs, represent a certificate of indebtedness and should not be reported as income, as income is not permitted on credit reports. Moreover, 15 USC 1681s2 ( A ) ( 1 ) prohibits a person from furnishing information to consumer reporting agencies if they know or should know the information is inaccurate. XXXX and XXXX have failed to maintain reasonable procedures to prevent such violations as required by 15 U.S. Code 1681e. Lastly, I wish to invoke my right to opt-out of your reporting services as per 12 CFR 1016.7. I respectfully request an immediate investigation into this matter and the removal of any inaccurately reported information from my credit file.
