As a loan servicer, XXXX is responsible for ensuring they have the correct contact details for their borrowers. If they had outdated information, they should have made proactive attempts to update it especially before marking accounts delinquent and reporting to credit bureaus. Servicers must notify borrowers before making significant changes to their accounts, such as transitioning out of forbearance. This is not just a best practice is an obligation under consumer protection laws that require lenders to act in good faith and provide borrowers with a fair opportunity to respond before taking negative credit actions! - When I requested a retroactive forbearance, which would have corrected the issue, XXXX refused, placing the full burden on me to check my account.
