Consumer Narrative

Disclosure As a consumer who is currently denied access to my credit report and the ability to track my disputes online by TransUnion, Experian, and Equifaxin what appears to be possible retaliation for my prior CFPB complaintsI am fully exercising my rights under the Fair Credit Reporting Act ( FCRA ) and documenting every step for potential legal escalation. Clarification This complaint is separate and distinct from any previously filed complaints against Equifax, Experian, and TransUnion. It addresses new violations and failuresspecifically, their refusal to provide verification documentation related to the XXXX XXXX dispute as required under FCRA 1681g and 1681i ( a ) ( 6 ) ( B ) ( iii ). This is not a re-dispute and is not duplicative in subject matter or legal basis. Reference Disputed Apple Card account beginning with 110001 ( as shown by TransUnion and Experian ) or ending in 0160 ( Equifax format ). The account is reported with a charge-off status, a past due balance of {$1800.00}, a credit limit of {$1600.00}, and a derogatory payment history. Subject Complaint Against Equifax, Experian, and TransUnion for FCRA Violations : Improper Verification of XXXX XXXX Account and Refusal to Provide Verification Documentation ( FCRA 1681g, 1681i ( a ) ( 6 ) ( B ) ( iii ), 611 ( a ) ( 5 ) ( A ) ) Narrative Experian XXXX XXXX Experian is reporting a last payment date of XX/XX/XXXX, yet simultaneously lists delinquencies from XX/XX/XXXX through XX/XX/XXXX, followed by a charge-off. A payment in XX/XX/XXXX would, under standard credit reporting logic, reset the delinquency timeline. The presence of both statements makes the reporting factually inconsistent, materially misleading, and in violation of FCRA 1681e ( b ) and 1681i. Correction is not possible without choosing one version over another deletion is the only lawful remedy. Experian also reports : A charge-off dated XX/XX/XXXX A payment XXXX months later in XX/XX/XXXX Continued charge-off notations through XX/XX/XXXX A balance of {$1800.00}, exceeding the {$1600.00} limit with no itemization These inaccuracies render the tradeline unverifiable. Despite these issues, Experian reaffirmed the account as verified after my dispute. I therefore demand immediate and permanent deletion of the XXXX XXXX tradeline under FCRA 1681e ( b ), 1681g, and 1681i. Bottom Line Experian reported this account as " current '' in XX/XX/XXXX despite it being over-limit and with no payment made. The following month ( XX/XX/XXXX ) was marked 30 days late with XXXX payment, which is logically impossible. Experian also lists the last update in XX/XX/XXXX, while simultaneously claiming the account is past due as of XX/XX/XXXX a XXXX gap. These contradictions make the tradeline legally unverifiable and subject to mandatory deletion. Supplemental Note : Experians Obstruction Although the above contradictions prove that Experians classification of the Apple tradeline as verified and accurate ( as of XX/XX/XXXX and reaffirmed XX/XX/XXXX ) was false, I am currently unable to submit additional supporting evidence due to Experians retaliation. Experian has : Suppressed prior account history Blocked access to my full credit report Removed my credit score, classifying me as not scorable These actions have hindered my ability to gather additional supporting documents. See Exhibit XXXX XXXX XXXX. Furthermore, Experian removed the XX/XX/XXXX last payment date from the tradeline post-dispute, making the account incomplete and unverifiable. Equifax XXXX XXXX Equifax ( Exhibit XXXX ) reports : A charge-off in XX/XX/XXXX A payment in XX/XX/XXXX, which should have re-aged the account Monthly charge-off notations through XX/XX/XXXX A balance of {$1800.00}, over the {$1600.00} limit and un-itemized This is materially inaccurate and violates Metro 2 and FCRA 1681e ( b ). Equifax has not sent any reinvestigation results or verification documentation. The XXXX XXXX report dated XX/XX/XXXX ( Exhibit F ) shows no updates or corrections. I therefore demand immediate deletion of the account. TransUnion XXXX Tradeline The TransUnion report dated XX/XX/XXXX ( Exhibit D ) is identical to the XXXX dated XX/XX/XXXX ( Exhibit C ). No corrections were made. TransUnion : Reports a XX/XX/XXXX charge-off Shows a XX/XX/XXXX payment Lists charge-off notations through XX/XX/XXXX Provided no documentation or reinvestigation results This is a clear violation of FCRA 1681e ( b ), 1681i. I demand deletion. Unified Complaint : Across All CRAs All CRAs report : XX/XX/XXXX charge-off XX/XX/XXXX payment Continued XXXX through XX/XX/XXXX Over-limit balance without itemization The source of the error may be the furnisher, but as a consumer, I reject the blame loop. The credit reporting agencies are responsible for the accuracy of the reports lenders use to approve or deny me. The tradeline is unverifiable, contradictory, and must be deleted across all CRAs. Verification Failures The following supporting documents were never provided despite repeated disputes and legal requests : Signed applications or agreements Itemized statements or account balance breakdowns Proof of consent to charges or fees Ownership documentation Authorized transaction records Late notice delivery proof Under FCRA and New York law ( GBL 380-j, 349 ), this tradeline can not lawfully be reported. Two Unlawful Possibilities 1. Blind reliance on e-OSCAR checkbox responses without reviewing actual documentation ( violates 1681i and 1681e ( b ) ) 2. Documentation was received but ignored, incomplete, or irrelevant, still violating 1681i and 1681g 30-Day Deadline Violation ( Equifax and XXXX XXXX ) Equifax received my dispute on XX/XX/XXXX via certified mail. As of today, no reinvestigation results have been provided. This exceeds the 30-day limit under 611 ( a ) ( 1 ) and 1681i. XXXX XXXX also failed to respond to my direct dispute or produce any documentation. Both accounts must be deleted immediately. Required Disclosures Not Provided All three CRAs failed to comply with 1681i ( a ) ( 6 ) ( B ) ( iii ) and 1681g, which require : Method of verification Documentation reviewed Name and contact of verifying party Key Legal Violations 1. FCRA 1681i Failed reinvestigation 2. FCRA 1681e ( b ) Reporting inaccurate data 3. FCRA 1681g Withholding verification documents 4. FCRA 611 ( a ) ( 5 ) ( A ) Must delete unverifiable info 5. FCRA 611 ( a ) ( 6 ) Failed to notify dispute outcome properly Legal Notice Final Opportunity If this unverifiable tradeline is not deleted within XXXX calendar days, I will pursue : Small claims lawsuits in New York State Complaints to the New York State Attorney General Complaints to the Better Business Bureau Additional federal complaints This is not a demand for compensation, but a lawful demand for permanent deletion. If resolved in good faith, I will consider the matter closed. Request for Documentation ( FCRA 611 ( a ) ( 6 ) ( B ) ( iii ), 1681g ) Please provide the following within XXXX calendar days : Method of verification All documentation reviewed Name/contact of verifying party See attached Exhibit Index for supporting documentation. Respectfully Submitted, XXXX XXXX
