In XX/XX/year>2024, Wheels Financial Group LLC dba LoanMart, in coordination with its agents XXXX XXXX and others, initiated a repossession of a vehicle that had already been lawfully transferred and titled to a different individual ( my father ). The loan account they claim is tied to the vehicle is in dispute, and no valid or verifiable contract or loan disclosures under the Truth in Lending Act ( TILA ) were ever provided. Despite multiple requests for verification, no signed contract or lawful disclosure statement has been produced by LoanMart or its affiliates. From XX/XX/scrub> 2024 to present, I ( the complainant ) initiated a lawful administrative process to resolve the matter and served multiple legal notices demanding verification, including a Conditional Acceptance, Notice of Default, and Affidavit of Truth. All notices went unrebutted. Instead of resolving the matter, LoanMart proceeded to file court pleadings that falsely named me as a party and submitted a Proposed Order containing forged content, including my name and implied signature, without my consent. This is now being escalated as potential forgery and fraud. I gave the company and its attorneys three days to settle, but they ignored all demands in bad faith. As a result of their ongoing misconduct, I have suffered. Financial harm due to loss of property and legal fees, Emotional XXXX confirmed by a licensed physician, Prescription medications and medical documentation ( XXXX, XXXX ) due to XXXX, short-term XXXX leave. Additionally, I have evidence that LoanMart operates as a " service provider '' under XXXX XXXXXXXX XXXX XXXX XXXX ), a XXXX and FDIC-insured bank . I have reason to believe that XXXX is the true lender and that they are failing to oversee or correct the misconduct of their agent, LoanMart. I am now submitting this to the CFPB because the company continues to : Refuse verification of the alleged debt, Commit possible fraud, forgery, and unfair lending practices, Use deceptive and harassing legal tactics, and Cause escalating financial, emotional, and reputational harm. I am requesting that the CFPB investigate these practices and require the company to Cease and desist all wrongful actions, Compensate for actual damages, and Provide full account and contract disclosure.
