Consumer Narrative
I have four bankruptcies shown on my credit Equifax Credit report under the XXXXublic Records section. Equifax obtained from this incorrect information from local, state and federal courts through a third party vendor, XXXX. These four bankruptcies are reported incorrectly and should not be shown on my credit report : as I voluntarily dismissed and have been paying down they dept and of the four b that should not be shown as the following incident occured : 1. Case ID # XXXX filedXXXX This was my original bankruptcy filed by my attorney 's office. My attorney 's was supposed to file a updated Wage Earner Plan and failed to do so or pay the court fee to file and the case was dismissed by the judge. As this was not my fault, I am not liable for the errors of my attorney with the courts and this should not be reported on my credit file as it is inaccurate. 2. Case ID # XXXX filed XX/XX/XXXX - Due to the judges dismissal of my original Case ID # XXXX due to the my attorney neglect, my attorney 's office had to re-file my bankruptcy case, therefore, this is not a new case but duplicate of my original case. 3. Case ID # XXXX filed XX/XX/XXXX - Dismissed on - This bankrupty was dismissed by the judge at court after the second hearing because my attorney failed to appear in court nor send anyone on their behalf to represent me, therefore, the judge dismissed the case. I met another attorney at this court date date that offered to represent my through his lawfirm. 4. Case ID # XXXX filed on XX/XX/XXXX - dismissed on XX/XX/XXXX - Due to the majority of available attorneys quiting at my first attorney 's office, he forwarded my case file to a new attorney to represent me. This attorney filed the case, we did a Wage Earner Plan for payments to my identified creditors. I began making payments through my Trustee, however, after 6 months or so, the courts increase my payment amounts and I could not afford the monthly payment increase amount so I voluntarily instructed my attorney to just have the case dismissed and I would make arrangements to payoff my debt without the assistance of the courts.
