THIS IS THE LAST SUMMARY I UPLOADED TO CREDIT CARD NOTIFYING THEM TO APPEAL. I UPLOADED DOCUMENTS WHEN I FILED THE DISPUTE. THE MERCHANT ONLY SENT MARKETING EMAILS AND I DELETED MOST WHEN I RECEIVED AN INITIAL CREDIT FROM THE CREDIT CARD. Re : Notice of Appeal Case # XXXX I received no product. No product was shipped. I ordered the product on XX/XX/year>. I canceled the order 4 minutes later based upon disturbing company reviews published by XXXX. The Seller did not address my cancellation but sent daily emails about how I am enjoying the use of the product, telling me that I haven't completed a medical profile and several other issues that do not acknowledge that I have canceled the product but imply that I am an active customer. Instead, the Seller bombarded me daily with an abundance of lengthy emails offering incentives * to purchase the Sellers largest package. I previously uploaded one of their twelve-page sales efforts. I am under no obligation to accept or decline the Sellers spam that offers incentives to make large purchases. I canceled my order immediately and had no further interest in their products. I canceled the XX/XX/year> order an additional 13 times trying to stop the spam. The Seller provides one email address. Their telephone numbers play a recording stating that just provides the email address. Seeking help, I called Discover and notified them of the Sellers failure to cancel the order, provide a refund and cease the spam mail. In response, Discover instructed me to file a dispute on XX/XX/year>. I filed the dispute on XX/XX/year>. I uploaded an factual evidence. Their reply named " Chargeback Evidence '' has no date or page number and states : due to the customers cancellation request, the order was placed on hold. The document, and by phone, ( credit card ) Dispute Supervisor XXXX stated that I am not entitled to a refund because on XX/XX/year> ( this is incorrect. It was on XX/XX/XXXX ), a dispute was filed. As a result the order was canceled but due to the ongoing dispute the refund could not be processed. Therefore the customers claim is unfounded. I uploaded evidence listing documents, merchant refund terms and more demonstrating the validity of my dispute. I canceled 4 minutes after placing the order and an additional 13 times. I provided proof of XXXX ( the name they used with me ) refund terms and claims. In the merchant 's reply, they imply that I conversed with their " team who, in response, offered a 30 % and 50 % discount that I never confirmed which caused the product to be placed on hold. '' Never happened - no conversation was ever offered, just spam that consisted of many incentives asking me to purchase large products, two of the many incentives were discounts.
