Consumer Narrative

XX/XX/XXXX Via CFPB Portal Consumer Financial Protection Bureau XXXX XXXX XXXX XXXX XXXXXXXX, IA XXXX Re : Response to XXXX XXXX / XXXX Complaint ID No. XXXX Consumer : XXXX XXXX To Whom It May Concern, I am writing to follow up on the response provided by Avant LLC regarding my previous complaint and dispute of inaccurate information appearing on my credit report. I respectfully disagree with XXXX conclusion that their reporting was accurate. Despite my multiple formal disputesincluding my original filing on XX/XX/XXXX, and again on XX/XX/XXXX, XXXX have not been provided with any verifiable documentation substantiating the alleged XXXX late payment for XX/XX/XXXX. Instead, XXXX refers me to their dashboard and reiterates general policies from their Cardmember Agreement, but fails to provide : A complete ledger of payments and dates received ; Documentation proving notification of late payment was sent and received ; Clear evidence validating that the payment in question was actually XXXX days late under the FCRA definition. Furthermore, my credit file currently reports this account as Current and with a {$0.00} Past Due balance, which contradicts the derogatory status previously reported. XXXX own response also states that only XXXX XXXX delinquency was reported, despite the credit bureaus initially showing both XXXX and XXXX late marks, which signals inconsistency and further supports my claim of inaccurate or unverifiable data. Under the Fair Credit Reporting Act ( FCRA ), data furnishers like XXXX are required to maintain reasonable procedures to ensure maximum possible accuracy of information they report ( XXXX ). If they are unable to fully verify the negative item with documented evidence, they are obligated to delete the item. Therefore, I am requesting the following : A copy of the full payment history and date-stamped ledger supporting the alleged delinquency ; A copy of any proof of notice sent to me regarding the alleged late payment ; If verification can not be completed in accordance with the FCRA, I request immediate deletion of the derogatory marks from my credit reports ; A formal notice of the reinvestigation results and an updated copy of my credit report as required by XXXX XXXX Code XXXX ( a ) ( XXXX ). This account has caused undue damage to my credit profile, and XXXX has not met the burden of proof required to continue reporting derogatory information. I am requesting CFPBs assistance to ensure compliance with federal credit reporting laws and protect my rights as a consumer. Sincerely, XXXX XXXX XXXX XXXX XXXX XXXX XXXX FL XXXX XXXX : XXXX Phone : ( XXXX ) XXXX
