Consumer Narrative

I am filing this complaint because my credit reports with TransUnion and XXXX contain multiple negative items that I believe are inaccurate, outdated, or improperly reported under the Fair Credit Reporting Act ( FCRA, 15 U.S.C. 1681 et seq. ) and the Fair Debt Collection Practices Act ( FDCPA, 15 U.S.C. 1692 et seq. ). As of XX/XX/XXXX, my reports show a payment history of only 88 % on-time, with XXXX late payments reported across multiple closed and open accounts. Several of these accounts, including XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX and XXXX are closed but still show multiple missed payments ( ranging from XXXX to XXXX ). I believe some of these late marks are either duplicate, outdated, or should have been updated when the accounts closed, per FCRA 1681c. In addition, I have an active credit card account with XXXX XXXX XXXX XXXX that is currently reporting as over the credit limit ( 103 % utilization ). This has a significant negative impact on my credit standing. I have made payments and asked the creditor to update this balance accurately, but it has not been properly updated, which may violate FCRA 1681s-2 ( b ) if the furnisher fails to report current information. I also have an account with XXXX XXXX that is currently marked as late, despite my efforts to bring it current and communicate with the lender. My report includes two active collections : XXXX XXXX XXXX XXXX ( {$1300.00}, opened XX/XX/XXXXXXXX ) and XXXX XXXX XXXX ( {$1500.00}, opened XX/XX/XXXXXXXX ). I have repeatedly asked these collectors to validate these debts as required by FDCPA 809 ( b ), but I have not received sufficient documentation. I believe they continue to report these balances in violation of my rights under the FDCPA. Furthermore, my reports show multiple hard inquiries in a short period XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXXXX/XX/XXXX ). I believe some of these were either not fully authorized or not clearly disclosed to me at the time they were made, which may violate FCRA 1681b ( c ). I have made multiple attempts to resolve these matters directly with the furnishers, debt collectors, and the credit bureaus by disputing the late payments, requesting removal or validation of collections, disputing unauthorized inquiries, and requesting that my utilization be reported correctly. However, these issues remain unresolved. I am providing supporting documentation, including screenshots of my credit report summaries, payment histories, utilization percentages, collections details, and the list of inquiries. I respectfully request that the CFPB investigate these matters, compel the involved parties to : 1 ) Fully verify or remove any inaccurate, unverifiable, or obsolete information per FCRA 1681i ( a ). 2 ) Ensure accurate updating of my account balances and payment history per FCRA 1681s-2. 3 ) Remove any hard inquiries that can not be verified as properly authorized. 4 ) Require debt collectors to provide proper validation or remove the collections per FDCPA 809 ( b ). This situation has caused significant harm to my credit score ( currently XXXX TransUnion, XXXX XXXX ) and limits my fair access to credit and financial opportunities. I am seeking a fair resolution to have my reports corrected, updated, or cleared of unverifiable negative items and to receive written confirmation of all corrections as required by federal law.
