I am filing this complaint against TransUnion and Experian for failing to remove unauthorized hard inquiries resulting from identity theft, despite my prior disputes and providing an FTC Identity Theft Report ( Report # XXXX ). These inquiries are harming my credit profile and privacy rights under the Fair Credit Reporting Act ( FCRA ). On XX/XX/XXXX, I discovered that unauthorized hard inquiries had been made on my TransUnion report by XXXX, XXXX XXXX, and XXXX XXXX without my knowledge or consent. Around the same time, on XXXX XXXX XXXX additional unauthorized hard inquiries appeared on my Experian report from XXXX XXXX, XXXX XXXX, XXXX XXXX XXXX, and XXXX XXXX XXXXXXXX. I also noticed that an unauthorized inquiry by XXXX XXXX XXXX was placed on my Experian report on XX/XX/XXXX. On XX/XX/XXXX, I sent dispute letters to both TransUnion and Experian demanding that these unauthorized inquiries be removed and included my FTC Identity Theft Report ( Report # XXXX ) to support my claim of identity theft. Despite these steps and my prior disputes, these unauthorized hard inquiries remain on my credit reports, violating my rights under the Fair Credit Reporting Act, including the permissible purpose requirements under 604 and the protections provided under 611 and 605B related to identity theft and unauthorized reporting. Under the Fair Credit Reporting Act, specifically 604 ( 15 U.S.C. 1681b ), my consumer report can only be furnished with my direct authorization, which I did not provide for these inquiries. Additionally, under 605B, the credit bureaus are required to block fraudulent information when they receive an identity theft report, which I have already provided to them.
