Consumer Narrative
XXXX : XXXX XXXX XXXX XXXX XXXX XXXX XXXX NY [ C/O XXXX ] XXXX XXXX Consumer Financial Protection Bureau XXXX XXXX XXXX XXXX XXXX XXXX Washington, D.C. XXXX Subject : Formal Complaint Regarding Inaccurate and Unauthorized Credit Reporting by Transunion, EQUIFAX, and EXPERIAN on behalf of XXXX XXXX Dear CFPB Representative, I am writing to formally lodge a complaint against XXXX XXXX for furnishing inaccurate, derogatory, and unauthorized information to the credit reporting agencies concerning an account previously held in my name. The account in question was opened on XX/XX/XXXXXXXX XXXX XXXX and closed on XX/XX/XXXX. However, my credit report inaccurately reflects that the account remained open for 3 years and 5 months, with the last reporting dated XX/XX/XXXX, XXXX is factually incorrect, given the account closure over a year earlier. Additionally, the account is now being reported as a charge-off, which I also dispute. If XXXX XXXX claims to have charged off the account as a loss, I assert that I am entitled to receive a Form 1099-C ( Cancellation of Debt ) for the alleged forgiven amount pursuant to IRS regulations and Title 26 of the U.S. Code . To date, I have not received any such tax document, which raises the question as to whether the debt was in fact canceled, sold, or continues to be collected oneach of which has different implications under the law. More importantly, I have repeatedly informed XXXX XXXX that I did not authorize or consent to the furnishing of any information regarding this account to the credit bureaus. These communications were made in writing and included an affidavit sent via certified mail. Despite clear notice, they have continued to report on this closed and disputed account, in violation of my consumer rights and without my consent. Furthermore, I explicitly stated in those communications that I conditionally require {$250000.00} in damages for each occurrence of unauthorized reporting. These terms were clearly laid out, yet XXXX XXXX failed to acknowledge or respond appropriately. Accordingly, I respectfully request the CFPB to : 1. Investigate XXXX XXXX furnishing of inaccurate, misleading, and unauthorized information to the credit bureaus and if transunion, EQUIFAX, and EXPERIAN investigated my complaints. 2. Require the deletion or full correction of all entries associated with this account, including the disputed charge-off status. 3. Determine whether the account has truly been charged off, and if so, whether a 1099-C was properly issued in compliance with federal tax laws. 4. Enforce any applicable penalties and compel XXXX XXXX to cease and desist from further unlawful reporting. 5. Recognize and support my right to pursue damages and enforce conditional terms communicated in writing. I invoke all applicable consumer protection laws, including but not limited to : Fair Credit Reporting Act ( FCRA ) Fair Debt Collection Practices Act ( FDCPA ) Truth in Lending Act ( TILA ) Uniform Commercial Code ( UCC ) United States Code ( USC ) Code of Federal Regulations ( CFR ) Enclosed are supporting documents, including copies of all correspondence sent to XXXX XXXX, certified mail receipts, and credit report excerpts highlighting the inaccurate and unauthorized entries. Furthermore this account is paid in full with no late or missed payments and must reflect that. Thank you for your time and attention to this matter. I trust that XXXX XXXX will uphold the integrity of federal consumer protections and ensure fair treatment of all consumers under the law. Sincerely, XXXX XXXX XXXX
