Consumer Narrative
CFPB Complaint Against TransUnion Subject : TransUnion Unlawful Reporting of Identity Theft Debt, Unauthorized Consumer Statement, and False Addresses I am filing a formal complaint against TransUnion for : 1. Failing to remove a fraudulent collection account ( XXXXXXXX XXXX XXXXXXXX ) XXXX. Failing to remove an unauthorized personal statement they placed on my credit report XXXX. Reporting false addresses on my credit file that I have never lived at All of this is the result of identity theft and violates the Fair Credit Reporting Act ( FCRA ), CFPB regulations, and FTC guidance. Background Fraudulent XXXX XXXXXXXX XXXX XXXXXXXX I am a victim of identity theft. An unknown individual incurred a debt reported by XXXXXXXX XXXX XXXXXXXX, which has been fraudulently placed on my TransUnion report. I never authorized this debt and have no business relationship with XXXXXXXX XXXX XXXX. I filed an Identity Theft Report with the FTC and a police report, and provided TransUnion with these documents and a written statement identifying this debt as fraudulent, requesting immediate removal under FCRA 605B ( 15 USC 1681c-2 ). TransUnion has failed to block and remove this debt in violation of the FCRA, despite having all required documentation. Unauthorized Consumer Statement TransUnion placed a consumer statement or dispute notation on my credit report without my authorization. Under FCRA 611 ( b ), consumers may choose to add a statement if a dispute is unresolved, but I never requested or approved any such statement, and it is derogatory and harming my credit opportunities. TransUnions insertion of this statement is inaccurate, misleading, and violates FCRA 607 ( b ) ( 15 USC 1681e ( b ) ). False Address Reporting TransUnion is reporting false addresses on my credit report : XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX I have never lived at these addresses, nor have I authorized their inclusion on my file. This is further evidence of identity theft and inaccurate data reporting. Legal Violations 1 FCRA 605B Identity Theft Blocking ( 15 USC 1681c-2 ) TransUnion is legally obligated to block fraudulent information within four business days of receiving my identity theft documentation. They have failed to do so. 2 FCRA 611 Dispute Resolution and Deletion ( 15 USC 1681i ) TransUnion must conduct a reasonable reinvestigation and delete unverifiable or inaccurate information. Courts have held XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX ) that CRAs can not simply parrot a furnishers unverifiable claims. TransUnions failure to remove the XXXXXXXX XXXX XXXXXXXX tradeline violates this provision. 3 FCRA 607 ( b ) Maximum Possible Accuracy ( 15 USC 1681e ( b ) ) TransUnion has failed to maintain accurate records by : * Reporting an unauthorized consumer statement * Reporting addresses where I have never lived * Continuing to report a fraudulent debt despite clear evidence of identity theft. 4 CFPB and FTC Guidance The CFPB and FTC require CRAs to remove unverifiable and fraudulent information, including when consumers submit identity theft reports. TransUnions actions are non-compliant. Harms Suffered Due to TransUnions actions : I have been denied housing, bank accounts, and bank loans. My credit score has suffered, harming my financial reputation. I have incurred out-of-pocket costs to monitor and dispute these issues. I have endured emotional distress and wasted significant time attempting to resolve issues that should have been resolved by law. Notice of Intent to Sue If TransUnion fails to comply promptly, I intend to pursue federal litigation against TransUnion for willful and negligent violations of the FCRA and related consumer protection laws. I will seek maximum statutory damages, actual damages for financial harm and emotional distress, attorneys fees, and any other relief permitted under the law. Conclusion I request the CFPBs immediate intervention to enforce my rights under the FCRA, secure the removal of this fraudulent debt, unauthorized consumer statement, and false addresses from my TransUnion credit report, and hold TransUnion accountable for their noncompliance. Thank you for your attention to this urgent matter.
