Consumer Narrative
I did not open, authorize, or benefit from this account. I have submitted my FTC Identity Theft Report, notarized affidavit, ID, and police report. Therefore, under 15 U.S.C. 1681c-2, this account must be permanently blocked and deleted from all credit reports. Furthermore, the way this account is being reported contains serious inconsistencies that violate federal law. At one point, the account reflected a {$33000.00} charge-off, but is now showing as a {$15000.00} charge-off after repossession. This defies the logic of charge-off accounting and violates GAAP, FCRA ( 15 U.S.C. 1681s-2 ( a ) ( 1 ) ( A ) ), and the Uniform Commercial Code 9-615, which prohibits double recovery. Reporting both a charge-off and repossessionwhile fluctuating balancesindicates false, deceptive, or misleading information being furnished to credit bureaus. This further proves that the information is unreliable and must be blocked. I have submitted valid documentation under federal law, and the burden is on the furnisher to prove with clear, verifiable evidence that I both authorized and benefited from the alleged account. Inconsistencies in your tradeline reporting further support deletion. Continued reporting may constitute willful noncompliance under FCRA. This account does not benefit me, was never authorized, and continuing to report it despite clear identity theft documentation shows willful negligence and aggravated identity theft under 18 USC 1028A.
