This letter is a formal and final demand that you immediately delete the inaccurate and unverified tradeline being reported by XXXX XXXX on my Experian credit report. Let me be absolutely clear. XXXX XXXX has failed to validate the alleged debt under the requirements of the Fair Credit Reporting Act 15 USC 1681i. What they provideda bogus lease and a so-called move-out statementdoes not meet the legal threshold for verification. These documents are not signed, are not itemized, and do not contain any proof of delinquency, amount owed, or legal liability on my part. This is not validation. It is an evasion of federal consumer protection law. Even XXXX, after conducting its own reinvestigation, deleted this same account due to lack of verification and documentation. If XXXX determined the debt to be unverifiable and unreliable, there is no justification for Experian to continue reporting it unless Experian is willfully ignoring the FCRAs reinvestigation standards. Lets be clear on the law since Experian is clearly not clear on the law FCRA section 1681i ( a ) ( 1 ) ( A ) requires Experian to delete any disputed information that can not be verified. That includes documents that are incomplete, vague, or fail to directly tie me to the alleged debt. FCRA section 1681i ( a ) ( 5 ) ( A ) also mandates that unverifiable items must be removed, not defended by blindly parroting what the furnisher says. If Experian is claiming this information is verified, I demand the exact documents you received from XXXX during your reinvestigation. If you can not provide documentation that includes my signature, a full itemized ledger, and legal proof of a balance owed, then your continued reporting of this account constitutes negligence at best and willful noncompliance at worst. We arent about to drag this out another 60 days because my next step will be a lawsuit. If your reinvestigation is properly being investigated, upload the documents and talk via the consumer financial protection, bureaus platform, not hide behind these sham delays! Please see the screenshot where XXXX quickly acknowledged the error/incorrection and the correction on the consumer financial protection bureaus portal and explained their process!!
