I received a copy of my XXXX, Equifax and XXXX credit report, and noticed 8 late payments that need to be deleted. It is as follows : DPT EDXXXX - XXXX Your agency has committed a violation of my federal and consumer rights ; evidence is provided in 15 USC 1681b ( 2 ) of the Fair Credit Reporting Act, which is detailed below. 15 USC 1681b ( 2 ) - permissible purposes of consumer reports, THE LAW CLEARLY STATES : ( 2 ) In accordance with the written instructions of the consumer to whom it relates. I did NOT give your agency written authorization or written instructions to report this information. Your agency has not only committed aggravated identity theft but has also falsely accused me of defaming my character, to name a few damages that may be awarded in court, in addition to violating the Fair Credit Reporting Act. As detailed below, XXXX, Equifax, and XXXX have also violated my consumer rights. 15 U.S. Code 1666b - Timing of payments ( a ) Time to make payments A creditor may not treat a payment on a credit card account under an open end consumer credit plan as late for any purpose. The disclosure of this information not only violates federal law but also constitutes aggravated identity theft and character defamation against me, similar to how your agency has harmed me ( 15 USC 1666b ) by failing to obtain my written consent to report such information. Late payments can not be reported if the consumer was not notified 21 days prior to the due date. It should state " mailed or delivered '' to the custome r.
