CFPB Complaint ( against Equifax and the Guarantors ) I am submitting this formal complaint against Equifax and the guarantor company ( hereafter referred to as the guarantor ) that recently denied my housing application, citing a consumer credit report obtained from Equifax. However, in a prior CFPB complaint filed against Equifax earlier this year, Equifax explicitly stated that it was not reporting any credit history under my name, allegedly due to an inability to locate any credit activity or records in the past XXXX years. Improper Use or Reliance by Guarantor ( FCRA 1681b ( a ) ( 2 ), ( 3 ) ) The guarantor relied on a non-existent or incomplete credit report from Equifax to deny me housing, without giving me a clear and complete adverse action notice, as required under FCRA 1681m ( a ). Request for XXXX and XXXX : I request a full investigation into XXXX handling of my credit file, including the circumstances under which it generated or shared a report used to deny my application. I request that Equifax provide me with a complete copy of any and all consumer disclosures and reports furnished to third parties over the past XXXX XXXX I also request the guarantor be compelled to disclose the exact version and contents of the Equifax report they used, and clarify the basis for their adverse decision. This denial has materially harmed my ability to secure housing and I demand corrective action. I reserve my rights to seek further remedies under FCRA, FTC regulations, and applicable state consumer protection laws.
