The CARD Act of 2009 states that : A creditor shall allocate the entire amount paid by the consumer in excess of the minimum payment amount to a balance on which interest is deferred during the last 2 billing cycles immediately preceding the expiration of the period during which interest is deferred. XXXX XXXX XXXXXXXX However, Discover does not allow this in their card member agreement, and refuses to allow the consumer to allocate money to the balance transfer balance in the last two billing cycles, as state is required by federal law. In addition to breaking federal law, this is a predatory arrangement for Discover, because they offer 3.99 % interest for 16 months and 0 % interest for 10 months on balance transfers. Consumers thinking they could gain some extra time to pay off debt for just 4 % are left without being able to pay off their previous balance transfer offer that expires sooner simply because the interest is higher on the newer balance transfer offer. It seems logical that the consumer would want to pay off the balance transfer that expires sooner so they dont get hit with 28 % interest. This is a complete scam, and consumers should be able to allocate payments where they decide. I called on the phone a few times and assume Discover has the recordings. The supervisor I spoke with was pretty rude and was adamant that they follow all state and federal laws and that there was nothing they could do.
