I am filing this formal complaint against XXXX XXXX XXXX XXXX XXXX XXXX XXXX ) for unlawfully reporting a late payment on my credit report, which is completely inaccurate and unsupported. Let me be clear : I never received a single periodic statement or valid billing notice that complies with the Truth in Lending Act ( TILA ), Regulation Z, 12 C.F.R. 1026.7 ( b ), which requires timely periodic statements at least 21 days before payment is due. You can not report a consumer as late unless you first give lawful presentment of the debt. This is a complete failure of compliance, they never sent me the bills, yet somehow penalized me for not paying them. Total disaster. This negative reporting is now blocking me from qualifying for a home, has destroyed my credit, and caused emotional damage, XXXX, and economic loss. I have sent a Conditional Acceptance for Value, and I do not refuse to pay. I simply demand the following proof before I consider the debt valid : Full proof that periodic statements were sent in compliance with TILA ; Evidence that Self still owns this account, and it was not securitized, monetized, or converted into an asset-backed security ; A copy of the original contract signed by me ; Accounting ledgers per GAAP to prove a true outstanding balance ; Written admission or denial of any 1099-C issuance or tax deduction for charge-off. If they can not provide these, this debt is unverified, this report is false, and this damage is unlawful. Pursuant to the Fair Credit Reporting Act ( FCRA ), as a federally protected consumer, I hereby revoke and withdraw any and all authorizationwhether written, unwritten, verbal, or non-verbal. This revocation applies retroactively and is effective immediately under 15 U.S.C. 6805. They are also violating : FCRA 1681s-2 ( a ) ( 1 ) ( A ) Reporting false, unverifiable information ; FCRA 1681e ( b ) Failure to ensure maximum possible accuracy ; XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX ) ; XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX ). They had every chance to do it rightand they didnt. I demand the late payment be immediately removed, the tradeline updated, and that XXXX XXXX XXXX XXXX cease all further negative reporting unless they can provide actual evidence. Failure to act will result in legal escalation, including IRS Form 3949-A for suspected tax fraud and FCRA litigation.
