To whom it may concern, The law is clear : If any information is deleted from a consumers file the information may not be reinserted unless the furnisher certifies that the information is complete and accurate AND the agency notifies the consumer in writing within 5 business days. 15 U.S.C. 1681i ( a ) ( 5 ) ( B ) Equifaxs failure to provide this required notice is a blatant violation of the FCRA and is now documented with evidence. 3. Refusal to Provide Method of Verification When I previously disputed a negative item " XXXX XXXX XXXX '' on my report, an Equifax representative refused to provide the method of verification, which violates : FCRA 611 ( a ) ( 6 ) ( B ) ( iii ) 15 U.S.C. 1681i ( a ) ( 6 ) ( B ) ( iii ) This law gives me the right to receive a description of the procedure used to determine the accuracy and completeness of disputed information. Denying this information is a violation of federal law and has further obstructed my rights as a consumer. On XX/XX/year>, I spoke with an Equifax supervisor who identified herself as XXXX. She verbally stated that Equifax does not send out reinsertion letters, despite this being required under 15 U.S.C. 1681i ( a ) ( 5 ) ( B ). I documented the call, and can provide further detail if requested. I informed her Equifax is the only credit agency reporting this account and she stated she can't remove it despite me informing her of the violations. DEMANDS Pursuant to my rights under the FCRA, I am demanding the following : 1. A full written explanation for the unauthorized placement of the fraud alert 2. Written documentation that certification was obtained from any furnisher whose account was reinserted 3. an admission that reinsertion notice were not sent 4. A full method of verification for each item I have disputed 5. A full investigation of all violations described above 6. Immediate removal of any account reinserted without following proper legal procedures 7. Immediate correction and update to my credit file to reflect accurate, lawful reporting NOTICE OF INTENT If Equifax fails to comply within the timeframes required by law, I will : File formal complaints with the Consumer Financial Protection Bureau ( CFPB ), Federal Trade Commission ( FTC ), and my State Attorney General Consider pursuing legal action under FCRA 616 and 617 ( 15 U.S.C. 1681n & 1681o ) for willful and negligent noncompliance, including seeking statutory and punitive damages I expect a full response within 30 calendar days, as required by the FCRA.
