Consumer Narrative

I am filing this complaint to dispute the accuracy of a charge-off account being reported by Experian and Equifax for the account listed as TOTAL XXXX ( Account # XXXXXXXX XXXX XXXX XXXX XXXX ). There are several issues that I believe violate the Fair Credit Reporting Act ( FCRA ) and the Fair Debt Collection Practices Act ( FDCPA ) : 1. The account is reported with a {$0.00} balance but is still being listed as a collection/charge-off, which is misleading and inaccurately reflects my financial status. 2. There are inconsistencies in the credit limit reporting : Experian shows a {$300.00} limit, while Equifax shows {$0.00}. This lack of uniformity indicates incomplete or incorrect data reporting. 3. Under the Fair Credit Reporting Act ( FCRA ) and guidance from the Consumer Financial Protection Bureau ( CFPB ), a creditor must wait a minimum of 180 days from the date of first delinquency before charging off an account. In my case, the account was opened in XX/XX/XXXX, and a charge-off was reported by XX/XX/XXXX, which does not allow for the full 180-day delinquency period. This indicates the account may have been charged off prematurely, in violation of federal guidelines. If the creditor can not provide clear documentation that this timeline was met in accordance with the law, I request that the charge-off be immediately removed from my credit report. 4. Equifax reports the account as derogatory but shows no payment history whatsoever for the month of XXXX and XX/XX/XXXX. This could indicate unverifiable or incomplete information, further discrediting the legitimacy of the reported derogatory status. I respectfully request the CFPB to investigate this matter. I also request that Experian And EQuifax be required to provide proper validation and supporting documentation for this account. If they can not provide verifiable and accurate data, I demand that the charge-off be removed from my credit report immediately. -- - * * Consumer Information : * * Name : XXXX XXXX Date of Birth : XX/XX/XXXX SSN : XXXX Phone : XXXX Address : XXXX XXXX XXXX XXXX XXXX XXXX MI XXXX
