Consumer Narrative
On XX/XX/XXXX I sent them the following email : Dear Comenity Bank, I am writing to formally dispute the late fees applied to my XXXX XXXX XXXX XXXX account and to file a formal complaint regarding the operation of your online payment portal. On XX/XX/2024, I made a payment of {$86.00}, covering the balance due, including an initial late fee. Then, on XX/XX/2024, I made an additional full balance payment online. I followed the instructions provided by your online portal, which indicated that paying the " full balance '' would satisfy the account. Despite these payments, additional late fees and interest charges were assessed. I believe your payment portal is deceptive, as it misleads customers into believing that paying the displayed full balance would bring the account current, without clarifying that additional charges or statement cycles could generate further fees. This misrepresentation has caused me to accrue unnecessary interest and additional penalties. For context, I acknowledge the initial late fee related to the XX/XX/2024, purchase of {$54.00} and the billing issues related to the XXXX and XXXX statements. However, after that purchase, I have not made any additional transactions with this credit card, clearly indicating that any further charges stem solely from fees, not usage. Given these facts, I respectfully request : A full reversal of the late fees and associated interest charges incurred after XX/XX/2024. A formal review of your payment portal communications and instructions to customers. If this dispute is not resolved promptly, I intend to escalate the matter by : Filing a formal complaint with the Consumer Financial Protection Bureau ( CFPB ). Submitting a report to the XXXX XXXX XXXX XXXX XXXX XXXX Exploring any additional regulatory channels available to address unfair billing practices.I look forward to your prompt response and resolution of this issue. The company has acknowledged that they incorrectly charged me late fees, which should not have been applied. These errors negatively impacted my credit score. While they have now credited back all the late fees, the damage to my credit remains. I am requesting that the company formally correct the credit reporting associated with these late fees and notify all relevant credit bureaus to remove any negative marks that resulted from their error.
