I am the victim of identity theft. A Capital One credit card account was fraudulently opened in my name on or around XX/XX/XXXX, using an old address I no longer resided at. I never applied for or used this account. Despite providing a signed written request, XXXX forms of valid government ID, and a police report ( filed XX/XX/XXXX ), Capital One has refused to provide me with application and account records, citing that I was deemed responsible for the account. Under the Fair Credit Reporting Act ( 15 U.S.C. 1681g ( e ) ), I am entitled to this documentation. I am requesting the Consumer Financial Protection Bureau 's assistance in compelling Capital One to release the full records associated with the account so I can prove it was fraudulently opened and have it removed from my credit report.
