Consumer Narrative
Complaint Summary : I am filing this complaint against TransUnion for failing to properly investigate and validate a collection account, despite my repeated formal disputes and requests for debt validation under the Fair Credit Reporting Act ( FCRA ) and the Fair Debt Collection Practices Act ( FDCPA ). Details of the Dispute Account in Question : Creditor : The XXXX XXXX Original Creditor : XXXX XXXX XXXX XXXX XXXX Account Type : Collection Date Opened : XX/XX/year> This account has been consistently reported as a collection, but balance on a collection and the date of last activity are incorrect, which constitutes a violation of federal law. Action Taken : I sent TransUnion a formal written request for debt validation, as permitted under the FDCPA ( 15 U.S.C. 1692g ), specifically requesting : Verification of the debt, including the original contract or agreement Documentation showing I am responsible for the debt A detailed account of how the balance was calculated TransUnion responded that the debt meets the requirements but did not provide any documentation, details of their investigation, or the information I specifically requested, as required by law. Additional Context : I have also requested debt validation directly from the alleged collection agency, but they have not provided any documentation or proof of the debt. Equifax has recently removed this collection item from my credit report after my dispute due to its inaccuracies, but TransUnion continues to report it without proper validation. Relevant Laws and Violations FCRA ( 15 U.S.C. 1681i ( a ) ) : TransUnion is required to conduct a reasonable reinvestigation of any disputed item and provide the consumer with the results, including the method of verification and the information relied upon if requested. FCRA ( 15 U.S.C. 1681e ( b ) ) : TransUnion must follow reasonable procedures to assure maximum possible accuracy of the information reported. FDCPA ( 15 U.S.C. 1692g ) : Upon request, the debt collector ( and by extension, the credit bureau when acting on their behalf ) must provide the consumer with validation of the debt, including supporting documentation. Nature of the Complaint TransUnion failed to provide documentation or details of the validation process, as required by the FCRA and FDCPA. TransUnion continues to report the collection account without validating the debt or providing the requested information. This lack of transparency and failure to properly investigate and validate the debt is a violation of my rights under federal law. Requested Resolution Immediate deletion of the disputed collection account from my TransUnion credit file, just as Equifax deleted it for being inaccurate. A full explanation of the investigation process, including the method of verification and all documentation relied upon. Assurance that TransUnion will comply with FCRA and FDCPA requirements in future disputes. Supporting Documentation See prior complaints submitted by me through CFPB Conclusion Neither TransUnion nor XXXX XXXX XXXX has fulfilled its legal obligations under the FCRA and FDCPA to validate the debt and provide required documentation. I respectfully request the CFPB to investigate this matter and require TransUnion to remove the unvalidated collection account from my credit report. Thank you for your attention to this complaint.
