XXXX XXXX XXXX, XXXX XXXX Subject : Urgent Complaint TransUnion Refuses to Block Fraudulent Collection Account ( XXXX XXXX XXXX XXXX XXXX {$8000.00} ) Dear Consumer Financial Protection Bureau, I am writing to formally file a complaint against TransUnion for failing to comply with the Fair Credit Reporting Act ( FCRA ) regarding a fraudulent collection account currently reporting on my credit file. The account in question is being reported by XXXX XXXX XXXX XXXX XXXX in the amount of {$8000.00}, related to an apartment at XXXX at XXXX XXXX XXXX that was fraudulently obtained using my stolen identity. I previously submitted all necessary documentation to TransUnion, including : My FTC Identity Theft Affidavit ( original version ) Police report documenting the identity theft A copy of my government-issued ID Social Security card Utility bill verifying my residence A supervisor in TransUnions Special Handling Department XXXX XXXX XXXX XXXX informed me that this fraudulent collection could not be blocked at that time due to clerical errors in the original FTC affidavit . I have since corrected and updated the FTC Affidavit Report, which now contains complete and accurate information consistent with the identity theft police report and all other supporting documentation. The FCRA, under 15 U.S.C. 1681c-2 ( a ), clearly states that a credit reporting agency must block fraudulent information immediately ( not within 30 days ) once a consumer submits : 1. Proof of identity 2. A police report 3. An FTC Identity Theft Affidavit 4. A statement that the information is not related to any transaction by the consumer I have now fully complied with all of these requirements. Moreover, I personally visited the apartment management office at XXXX XXXX XXXX XXXX, where the manager reviewed the records and verified that the individual who signed the lease does not match my physical description or identifying details. Despite this overwhelming evidence, TransUnion continues to allow the fraudulent XXXX XXXX XXXX XXXX XXXX account to appear on my credit report, in direct violation of FCRA 1681c-2 and 15 U.S.C. 1681e ( b ) ( Maximum Possible Accuracy ). Requested Relief : I respectfully request that the CFPB enforce TransUnions legal obligation to : Immediately and permanently block/delete the XXXX XXXX XXXX XXXX XXXX account from my TransUnion credit report Ensure that this fraudulent item is not reinserted unless full legal compliance under 1681i ( a ) ( 5 ) ( B ) is met Provide me with written confirmation of the deletion This inaction by TransUnion has continued to cause me harm, despite my full cooperation and submission of federally recognized identity theft documentation.
