I am filing this formal complaint against XXXX XXXX XXXX XXXX XXXX. ) for continued inaccurate, deceptive, and noncompliant credit reporting in violation of the Fair Credit Reporting Act ( FCRA ) and XXXX XXXX data formatting guidelines. Critical Errors & Legal Violations : False High Balance on Secured Card My secured XXXX card had a {$250.00} credit limit, yet it is now showing a {$430.00} high balance on my TransUnion report. This is not only factually incorrect, but also an alarming sign of data manipulation. A secured card can not exceed its deposit limit unless due to fees or mishandled reporting which were never disclosed or consented to. FCRA 1681e ( b ) Failure to Ensure Maximum Accuracy Reporting a high balance 75 % over the original credit limit constitutes gross negligence. It unfairly skews my credit utilization and damages my FICO scores. XXXX XXXX Noncompliance Contradictory Status Codes The account is simultaneously coded as : Closed Charged Off/Collection Past Due : {$180.00} Balance Owed : {$180.00} This directly violates XXXX XXXX protocol, which prohibits simultaneous charge-off and past due statuses on a closed tradeline. This inconsistency inflates derogatory scoring metrics unlawfully. 1099-C Not Issued for Charged-Off Debt Per IRS regulations, any charged-off account exceeding {$600.00} requires the creditor to issue a Form 1099-C to the consumer. I have never received a 1099-C for this tradeline. If the debt was never officially canceled, then continued reporting as charged off is fraudulent and violates FCRA 623 ( a ) ( 5 ).
