Consumer Narrative
I am submitting this complaint because Equifax is reporting inaccurate and unverifiable information regarding a XXXX XXXXXXXX account ( partial number XXXX ), which has been listed as a charge-off for over 20 consecutive months with no updates, no payments, and no clear evidence of ongoing collection. The reporting is also inconsistent across credit bureaus. While XXXX marks the account as sold to another lender, Equifax still reports it as if it is actively owned by XXXX XXXXdespite the fact that no activity has occurred since the charge-off began. I previously disputed this account, yet no documentation or validation has ever been provided to support the continued charge-off status. The account continues to be reported as derogatory each month, without any new developments, which creates a misleading and punitive record on my credit file. This practice violates multiple provisions of the Fair Credit Reporting Act ( FCRA ) : 15 U.S.C. 1681e ( b ) : Requires that data reported be accurate and up-to-date. 15 U.S.C. 1681i ( a ) : Mandates deletion of data that can not be verified after a dispute. 15 U.S.C. 1681s-2 ( b ) : Prevents furnishers from continuing to report unverifiable or outdated information. Federal case law reinforces this right : in Cortez v. Trans Union ( 617 F.3d 688 ) and Seamans v. Temple University ( 744 F.3d 853 ), the courts held that if information can not be verified, it must be deletedwithout exception.
