XXXX XXXX XXXX XXXX XXXX XXXX XXXX, XXXX, CA XXXX Dear XXXX XXXX XXXX and XXXX XXXX, I am writing to formally file a complaint regarding a highly unprofessional and potentially unlawful experience I had with your dealership during a recent attempt to finance a vehicle. On Friday XX/XX/year>, I spoke with a sales representative, XXXX, regarding financing a used XXXX XXXX. I clearly stated I intended to use a co-signer my mother who resides in Florida and has a credit score of XXXX with a clean payment history. I was informed that this process may require FedEx for signatures due to her location, and I confirmed I was fine with this. Despite several attempts to get updates from XXXX, I received vague responses and no clear information until XX/XX/year>, when I was told I had been approvedwithout my co-signer and at a 13 % APR. I was also told that my co-signer was not approved due to a missed payment, which is entirely false. Upon further investigation, I discovered : My credit was pulledmultiple times ( at least 5 ) without being consulted. My co-signers credit was also pulledmultiple times without direct consent. I was told that only 2 and 1 pulls were made respectively a blatant falsehood. The dealership submitted an application using a {$0.00} down structure that I never agreed to. I had explicitly stated a {$2000.00} {$2500.00} down payment. When questioned, a manager named XXXX falsely claimed this information came from me during our call not from any documented agreement. When I requested to see the application, XXXX stated, there is no paperwork, yet continued referencing information supposedly from it. These actions appear to violate multiple consumer protection statutes, including but not limited to : TheFair Credit Reporting Act ( FCRA ) for unauthorized credit inquiries. State laws regardingmisrepresentation and deceptive business practices. I am requesting : 1. A full accounting and written documentation of all credit inquiries made under my and my co-signers names. 2. A copy of the auto loan I was approved for as the sole buyer at 13 %. 3. A written explanation of your dealerships protocol regarding credit applications and multiple lender submissions. 4. The removal of all unauthorized or excessive hard credit inquiries. 5. A formal apology and commitment that such practices will be reviewed and corrected. If this matter is not resolved within10 business days, I will be pursuing : Complaints with theConsumer Financial Protection Bureau ( CFPB ), FTC, andCalifornia Attorney Generals Office.
