Consumer Narrative

To Whom It May Concern, I am submitting this formal complaint against three furnishersAlly Financial, XXXX XXXX XXXX XXXX, and XXXX XXXX XXXXfor ongoing and erroneous reporting of late payment information on my credit reports. These entries are materially inaccurate and do not reflect the complete payment history, circumstances, or required verification standards as prescribed under federal law. The tradelines in question are as follows : XXXX XXXX # XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX Date opened : XX/XX/year> ; High balance : {$40000.00} ; Reporting late payments XXXX XXXX XXXX XXXX # XXXX Date opened : XX/XX/year> ; High balance : {$40000.00} ; Reporting late payments XXXX XXXXXXXX XXXX XXXX # XXXXXXXX XXXX XXXX XXXX XXXX Date opened : XX/XX/year> ; High balance : {$2500.00} ; Reporting late payments These negative marks have appeared on my reports without sufficient validation, documentation, or correction, even after initial disputes. Under 15 U.S.C. 1681i ( a ), the credit reporting agencies and furnishers are required to reinvestigate disputed information and correct or delete it unless they can verify its accuracy. These furnishers have not provided such verification, nor have they responded with any reasonable explanation or substantiation. Further, under 15 U.S.C. 1681s-2 ( a ), information furnishers must report with maximum possible accuracy. The recurring reports of late payments, without proper date tracking or consideration for mitigating factors such as temporary hardship or administrative error, reflect neither accuracy nor fairness. The lack of transparency or willingness to correct these issues is causing demonstrable harm. As a result of these unresolved inaccuracies, I have experienced credit denials, increased interest rates, and emotional stress. These furnishers are in breach of their obligations under the Fair Credit Reporting Act ( FCRA ), including their responsibilities to promptly correct or remove erroneous data, as well as to respond to disputes with full evidentiary support. I respectfully request the Consumer Financial Protection Bureau to initiate an investigation into these reporting practices and hold the responsible entities accountable under the FCRA. I am requesting the complete removal or correction of these negative entries unless they can be fully validated and documented in compliance with 15 U.S.C. 1681i and 1681s-2. Should this matter remain unresolved within the next 10 business days, I reserve my right to escalate the issue to the Federal Trade Commission, my State Attorney General, and pursue civil relief under 1681n and 1681o for willful or negligent noncompliance. Thank you for your attention and commitment to protecting consumer rights under the law.
