Consumer Narrative
I am filing this complaint against XXXX XXXX XXXX XXXX XXXX ( XXXX ) for mishandling a legitimate paid account, failing to act appropriately in response to identity theft involving a second account, and violating consumer protection laws under the FCRA, TILA, and UDAP. Violations FCRA : Failure to report accurate and complete information ; unauthorized deletion of tradelines ; failure to correct disputed information after receiving proper notice. TILA : Failure to provide periodic statements and legally required disclosures for an account reflecting a transferred balance. UDAP : Engaging in deceptive and confusing practices in the creation, handling, and communication surrounding multiple accounts tied to the same balance. Summary of Events According to XXXX own documentation, a credit account reflecting a {$2500.00} balance showed a {$0.00} balance as of XX/XX/year>, with the billing statement thanking me for paying the balance in full. Despite this confirmation, XXXX later reported the account as charged off for the full balance, significantly damaging my credit score. In response, I submitted a formal dispute requesting correction to reflect accurate payment history and closure. Instead of correcting the tradeline to Closed Paid in Full Never Late, XXXX deleted the tradeline entirelyremoving years of positive payment history and compounding the damage. In XX/XX/year>, a new account reflecting the same {$2500.00} balance appeared in XXXX system. I received no disclosures, account-opening documentation, or periodic statements for this account. On XX/XX/year>, I made a {$100.00} payment in good faith, assuming the balance had been transferred from my original account. XXXX accepted the payment, failed to issue billing statements, did not report the account to credit bureaus, and later removed it from my portal without explanationviolating TILA disclosure and servicing requirements. In XX/XX/year>, I received a letter dated XX/XX/year>, stating that XXXX had sold a credit card account with the same {$2500.00} balance to a third-party collector. I submitted a formal fraud dispute and an FTC Identity Theft Report. After receiving my XXXX credit report in midXXXX, I discovered that XXXX had deleted the original tradeline entirely rather than correcting the reporting. On XX/XX/year>, I contacted XXXX again to request that the account be reinstated and reported accurately. To date, there has been no resolution or update.
