I am submitting this formal complaint regarding the improper repossession practices and unlawful disposal of personal property conducted by Wilshire Consumer Credit XXXX lienholder ), XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX ( repossession agent ), and XXXX XXXX ( auction company ). These events concern the repossession of my XXXX XXXX XXXX, which occurred on XXXX, XX/XX/XXXX, in XXXX, XXXX. Timeline of Events : XX/XX/XXXX : My vehicle was repossessed by XXXX XXXX on behalf of Wilshire Consumer Credit. XX/XX/XXXX : I submitted payment in full for the loan and towing fees. Although the payment was visible in Wilshires system, the vehicle was not released due to the payment not having fully processed. XX/XX/XXXX : A scheduled appointment to retrieve my personal belongings was canceled the morning of due to a " hold harmless '' issue. XX/XX/XXXX : A second scheduled retrieval attempt was made, only to discover that the vehicle had already been transferred to XXXX XXXX, where it had been detailed and stripped of all personal belongings on instruction from Wilshire. At no point was I notified that the vehicle would be transferred prior to my scheduled appointment. Additionally, no reasonable opportunity was provided to retrieve my property. I was not offered a location for pick-up of my items ; instead, I was told on XX/XX/XXXX by Wilshire that the items were either at the auction house or the tow yard, but that they were unable to confirm who detailed the vehicle or what happened to the belongings. Missing Personal Property : The contents removed and discarded from the vehicle include, but are not limited to : Childrens birth certificates Childrens social security cards Martial arts gear and equipment Essential tools used for my profession in solar installation These items are not only personally significant but also include sensitive and irreplaceable documents, as well as tools that are crucial to my ability to earn a living. Response from Involved Parties : XXXX XXXX confirmed on XX/XX/XXXX that the vehicle was detailed under instructions from Wilshire Consumer Credit in preparation for auction, and that all contents were removed and discarded. Wilshire could not identify where the items were taken, who removed them, or who performed the detailing. Legal Violations and Consumer Rights Issues : XXXX Business & Commerce Code 9.609 ( c ) : Requires repossessors to refrain from breaching the peace and to allow owners to reclaim personal belongings. I was denied this opportunity entirely, despite two scheduled retrieval dates. Texas Deceptive Trade Practices Act ( DTPA ) : Misrepresentation, denial of access, and destruction of property constitute deceptive business practices. Unlawful Conversion of Property : Personal property was removed and destroyed without my knowledge or consent, and no effort was made to return it.
