Dear Consumer Financial Protection Bureau, I have forwarded complaints to your agency, before, regarding this alleged mortgage servicer. I am, again, submitting a complaint, and this complaint is regarding XXXXXXXX XXXX XXXXXXXX and their inaccurate reporting of late payments on my USDA-backed mortgage, despite my documented medical incapacitation and the protections afforded under USDA and federal credit laws. Their erroneous reporting is, unfairly, affecting me negatively. I always communicated, in good faith, with this entity. I was medically incapacitated and placed on unpaid medical leave during the periods in which XXXX reported me as late once in XXXX and once in XXXX. I notified the servicer in writing of my status and provided documentation, expecting to receive protections under USDA loan servicing guidelines. Nevertheless, XXXX reported late payments to the credit bureaus. This is a direct violation of : - USDA Servicing Handbook HB-1-3555, Ch. 18.2 & 18.10 : Requires servicers to offer hardship assistance such as special forbearance and deferment for borrowers facing medical hardship. It also mandates that servicers act to prevent delinquency-related adverse credit reporting. - Fair Credit Reporting Act ( FCRA ), 15 U.S.C. 1681s-2 ( a ) ( 1 ) ( A ) : Prohibits furnishers from reporting information they know or reasonably should know is inaccurate. - Real Estate Settlement Procedures Act ( RESPA ), 12 U.S.C. 2605 ( e ) : Requires mortgage servicers to respond to notices of error and to investigate consumer complaints diligently and fairly. - Equal Credit Opportunity Act ( ECOA ), 15 U.S.C. 1691 : Prohibits servicers from using policies or practices that result in discrimination or inequitable treatment, including the failure to provide relief when hardship is documented. My loan has since been paid off in full, yet these derogatory marks remain on my credit report, unfairly harming my financial reputation and access to housing. This debt collector, turned mortgage servicer, is not BBB accredited. I respectfully request that the CFPB investigate this matter and compel XXXX XXXX Services to : 1. Remove the inaccurate late payments from my credit report. 2. Issue a correction to all major credit bureaus. 3. Somewhere in * * * * * * * * * *. We updated it. Then i was transferred to the correct department. I explained to the gentlemen why I was calling and he didn't seem to care and was just in a rush to get me on and off the line. I then I asked if it was normal to allow people to call in on the account and make unauthorized charges. He then said please hold and cam back XXXX mins later to inform he process my account for review but he never listened to what I was trying to accomplish or my security concerns about my acct just put me on hold to to an escalations cue in which I head for XXXX mins with no one ever picking up Initial Complaint Date : XX/XX/XXXX Type : Order Issues Status : Problem Description : I sent XXXX XXXX {$5800.00} in XXXX to cover my XXXX house payment with {$850.00} going towards my monthly payment and the additional {$5000.00} to be applied to my principal mortgage balance. XXXXXXXX XXXX took the {$5000.00} and disbursed it how they saw fit. They took almost {$1000.00} in FUTURE interest on a mortgage loan that has never been past due. That should be illegal. They should be fined for stealing from their customers. I am considering suing this company if they do not fix this immediately and apply the entire {$5000.00} toward the principal which was my original intent. Looking at my mortgage payments and recent history in their system shows that I had been sending extra payments quarterly to pay down my principal balance, but this greedy company is doing everything to make sure I can not pay off the mortgage early. This company needs to be investigated for mortgage fraud.
