XXXX XXXX XXXX XXXX XXXX ( the cardholder or the business ) has maintained a credit facility with AMERICAN EXPRESS for nearly XXXX XXXX Without notice to the cardholder, on XXXX, XX/XX/year>, the cardholder received an email notification that the credit issuing agency, AMERICAN EXPRESS ( the company ), was cancelling the business 's accounts. The company provided no information regarding the cancellation of the cardholder 's account. After the cardholder called AMERICAN EXPRESS 's customer service number, the cardholder was transferred from department to department over a XXXX phone call. The company 's agents refused to explain " why '' the accounts were canceled. After nearly XXXX XXXX, the cardholder was able to reach an agent who explained that the cardholder 's accounts were cancelled due to what was referred to by the company 's agents as the " bad faith '' actions of the cardholder. When the cardholder asked where in the cardmember agreement { between the cardholder and the company } the term " bad faith '' was defined, and additionally, what paragraph and subsection of the cardholder agreement explained what actions by the cardholder constituted, defined, explained, expounded, or pointed to the activities, actions, conduct, or performance of the cardholder that supported " bad faith '' on behalf of the cardholder, the company 's agents could not or would not supply this information and eventually terminated the phone call with the carholder while the cardholder was in mid-sentence. According to a statement made by one of the company 's representatives, it is speculated ( by the cardholder ) that the company canceled the cardholder 's accounts due to its ongoing disagreement with a vendor, XXXX : a company that overcharged the cardholder every month and would not conduct itself according to its agreements for cellular services with the cardholder. The cardholder relied upon the company to back the cardholder 's claims and protect the cardholder 's rights to be charged for services by the vendor XXXX XXXX XXXX ) in accordance with the terms and agreements between XXXX XXXX and the cardholder. To this end, the cardholder utilized its facility with the company to act as its agent and disputed the overcharged amount each month against XXXX. Each month that XXXX overcharged the cardholder, the cardholder would submit a dispute. The company would support this dispute by refunding the overcharged amount to the cardholder, effectively " settling the dispute '' in favor of the cardholder. The termination of the cardholder 's credit facility will irreparably harm its ability to conduct its business due to the account 's closure and its inability to draw from or utilize the credit line to maintain its daily operations. Furthermore, the cardholder will suffer financial and material losses and hardship that will injure its ability to pay for installment bills, subscriptions, dues, fees, and operating costs related to its operation and a potentially substantial reduction in the cardholder 's credit score.
