Consumer Narrative
In XX/XX/XXXX, I filed for XXXX XXXX bankruptcy. My mortgage was transferred to XXXX XXXX XXXX, effective XX/XX/XXXX. However, though I was still making payments to my previous mortgage company ( XXXX ), XXXX XXXX began to bill me for those payments as well. Essentially, requiring that I pay double mortgage payments for XXXX, XXXX & XXXX and charging associated fees. When I contacted them via phone I was told to send proof of my payments to the previous mortgage company via their Contact Us email form on the website, and someone would get back to me. More that XXXX months later, I have still not received a response. In XX/XX/XXXX, a motion was filed with bankrupty court saying that I was delinquent for the payments as well as associated fees. My lawyer advised that they would have to communicate with XXXX XXXX on my behalf and that I should stop payments until a settlement was reached. In XX/XX/XXXX, a settlement included the duplicate payments and assessed fees. I was required to pay a lump sum of {$1500.00}, which was paid on XX/XX/XXXX. Then in addition to my regular monthly payment beginning XX/XX/XXXX of {$950.00}, I would also include an additional amount of {$450.00} each month toward the amount in arrears until it was paid off. I made each payment as described until my bankruptcy was dismissed in XX/XX/XXXX. I contacted XXXX XXXX to determine how to proceed since the bankruptcy was no longer in place. I was informed of that I was in arrears and owed payments from XX/XX/XXXX to XX/XX/XXXX. This led me to believe that none of the payments I had made directly to XXXX XXXX have been applied to my account. I requested this be investigated and was told someone would contact me. But I was offered a payment plan to bring my mortgage up to date. I completed the mortgage payment plan on time each month and called to confirm as well. After being told each time I was on track for my regular mortgage payment to resume with the XX/XX/XXXX payment. To date, I have {$1600.00} in fees, for which I have asked for an explanation of multiple times. I'm merely transferred to another department, which disconnects after several minutes. Additionally, there is a discrepancy between the statements I receive, the online loan summary/payment details, and the information that is communicated to me by the representative each time I contact XXXX XXXX XXXX phone. I am asking for an accurate accounting of every payment that I have made as well as a reversal of the {$1600.00} in fees that seem to be illegal at worst and superfluous at best. Additionally, I would like XXXX XXXX to be required to provide accurate statements that reflect the same in all communication channels. Though I understand this to be a subprime lender, I don't believe that exonerates them from practicing ethically. Kind Regards, XXXX XXXX XXXX XXXX XXXX
