In XX/XX/year>, XXXX XXXX XXXX began reporting a negative tradeline to the credit bureaus for an account they claim to have purchased from XXXX XXXX XXXX of South Carolina, XXXX. I do not recall authorizing or opening this account, nor did I give permission for them to access or report on my credit. I never received any notification of the alleged debt prior to it appearing on my credit report. Since then, I have received numerous harassing phone calls often before XXXXXXXX XXXX and after XXXXXXXX XXXX, including calls as late as after XXXX XXXX. Many of these calls are pre-recorded messages or robocalls, not live human callers. These actions violate the Fair Debt Collection Practices Act ( FDCPA ), 15 U.S.C. 1692c ( a ) ( 1 ), which prohibits debt collectors from contacting consumers by phone outside the hours of XXXX XXXX to XXXXXXXX XXXX local time without prior consent. Additionally, repeated automated/pre-recorded calls without consent may also violate the Telephone Consumer Protection Act ( TCPA ). I have not given consent to receive robocalls or calls at these times and consider this contact both excessive and harassing. I am requesting : Immediate removal of the tradeline and unauthorized inquiry from all credit reports ; An investigation into the harassing and unlawful phone call practices ; That all communication cease unless legally validated and made in compliance with FDCPA and TCPA.
