I am an XXXX XXXX service member and a Louisiana resident. I entered XXXX XXXX on XX/XX/year>, and the account in question has been active throughout my military service. Under Louisiana Revised Statute RS 29:312, creditors are prohibited from charging more than 6 % interest per year on any obligation or liability incurred by a service member or their spouse during a period of XXXX XXXX. This applies to all debts, regardless of when they were incurred, and does not require that the obligation predate military service. The statute explicitly states in Paragraph D that the creditor shall not charge, collect, or receive more than 6 % interest during the period of XXXX XXXX. This requirement is automatic upon documentation and not subject to discretionary approval. I am submitting this complaint because the creditor has continued to charge interest in excess of 6 %, in violation of RS 29:312. While I have not previously submitted documentation directly to the creditor, the Louisiana law places the burden on the creditor to comply once military status is established. I am requesting a full review of my account and a refund of all interest and fees charged in excess of 6 % during the duration of my XXXX XXXX service. I have attached my DD Form 4 ( enlistment contract ) and XXXX XXXX orders to verify eligibility.
