Consumer Narrative
To : Credit Reporting Agency Subject : Request for Deletion of Unverifiable Account To Whom It May Concern : I am writing to formally request the removal of an unverifiable and previously disputed account from my credit file maintained by your agency. The account in question is a charge-off reported by XXXX XXXX XXXX XXXX in the amount of {$9600.00}. This account was previously reported to my XXXX credit report. Following a formal dispute, XXXX completed its investigation on XX/XX/year>, and subsequently deleted the account from my file. According to the Fair Credit Reporting Act ( FCRA ), if a credit reporting agency is unable to verify the accuracy of a disputed item, that item must be deleted from the consumers credit file ( 15 U.S.C. 1681i ( a ) ( 5 ) ( A ) ). The fact that XXXX has deleted this account is strong evidence that the account can not be verified and thus should not be reported by any other consumer reporting agency. Continuing to report information that has been found to be unverifiable or inaccurate by one agency violates the FCRA and constitutes an unfair and negligent reporting practice. I am formally demanding the immediate removal of this unverifiable XXXX XXXX XXXX XXXX account from my credit file. This demand is being made pursuant to : - FCRA 611 ( 15 U.S.C. 1681i ) : Reinforces your obligation to investigate and remove disputed information if it can not be verified. - FCRA 607 ( b ) ( 15 U.S.C. 1681e ( b ) ) : Requires reasonable procedures to assure maximum possible accuracy of consumer report information. - FCRA 623 ( a ) ( 5 ) : Prevents furnishing data that is known to be inaccurate or unverifiable. You are required by law to complete your reinvestigation within 30 days of the receipt of this dispute. Failure to remove this unverifiable item within that timeframe will place you in violation of the FCRA, which may entitle me to seek damages, file a complaint with the Consumer Financial Protection Bureau ( CFPB ), and pursue civil legal remedies under FCRA 616 and 617 ( 15 U.S.C. 1681n, 1681o ), which allow for recovery of actual, statutory, and punitive damages, along with attorneys fees. Please update my credit report accordingly and provide written confirmation of the deletion. Additionally, I request a free updated copy of my credit report reflecting this change, as required under FCRA 611 ( a ) ( 6 ) ( B ) ( ii ). Sincerely, XXXX
