Dear Cfpb, Equifax, Experian, Transuion Legal Department ; I am filing this complaint due to the ongoing failure of the credit reporting agencies ( Equifax, Experian, and TransUnion ) to conduct a reasonable reinvestigation of several disputes I have submitted in violation of the Fair Credit Reporting Act ( XXXX ), specifically XXXX U.S.C. XXXX ( a ). Despite multiple authenticated and properly documented disputes, including submission of identity theft affidavits, I continue to receive dismissive and generic template responses stating that my disputes " do not appear to have come from me or an authorized representative. '' These baseless denials are being used as a pretext to avoid investigation. The law requires a reasonable reinvestigation any time a consumer disputes the accuracy of information, regardless of the perceived source of the dispute. Your obligations under XXXX ( a ) ( XXXX ) ( A ) are clear : you must conduct a reasonable reinvestigation to determine whether the disputed information is inaccurate. Moreover, the courts have held in XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX ( XXXX Cir. 1997 ), that a credit reporting agency may not rely on a creditors investigation but must conduct its own reasonable investigation. This failure to investigate not only violates FCRA XXXX but constitutes willful noncompliance under XXXX U.S.C. XXXX, which subjects your organization to liability for actual damages, punitive damages, and attorneys fees. Additionally, under XXXX U.S.C. XXXX ( b ), once a furnisher receives notice of a dispute from a CRA, it is also required to conduct its own investigation and report the results to the CRA. Failing to do so further exposes them to legal liability.
