Consumer Narrative
I am submitting this complaint against Equifax due to the improper reinsertion of a previously disputed and deleted account, as well as the continued reporting of inaccurate information. I previously filed a dispute regarding a tradeline reported by XXXX XXXX XXXX, and the account was subsequently removed from my Equifax credit report. However, I recently received a letter from Equifax ( attached ) stating that the account has been reinserted. The reinserted tradeline includes inaccurate information, most notably an incorrect account opening date. The date currently being reported does not reflect the actual date the account was opened. This error remains uncorrected even after the item had already been deleted following a dispute. Furthermore, Equifaxs records show that XXXX XXXX submitted an update to this tradeline on XX/XX/year>, just four days after they told the CFPB ( in response to a previous complaint ) that the information was already accurate and required no changes. This calls into question both the validity of the certification process and the accuracy of the data being reported. Under the Fair Credit Reporting Act ( FCRA ), specifically 1681i ( a ) ( 5 ) ( B ) : A credit reporting agency may not reinsert previously deleted information unless the furnisher certifies the accuracy of the information. The agency must provide written notice to the consumer within five business days of any such reinsertion. In this case : I was not provided with sufficient or timely notice of the reinsertion The reinserted information remains inaccurate There is no evidence that Equifax obtained a proper certification of accuracy from the furnisher I am requesting that the CFPB : 1. Investigate Equifaxs handling of this account reinsertion 2. Require permanent deletion of the tradeline if accurate certification and data can not be verified 3. Review whether Equifax complied with all relevant FCRA reinsertion and notification procedures 4. Enforce any necessary penalties or corrective actions
