I just checked my updated credit report and saw that Experian reinserted an account ( XXXX XXXX XXXX Account Number XXXX ) that was previously deleted. This account had already been removed after a dispute, and now it's suddenly back like nothing happened, without warning, without verification, and without my permission. This is a clear violation of multiple sections of the Fair Credit Reporting Act ( FCRA ). Under 15 U.S.C. 1681i ( a ) ( 5 ) ( B ), Experian is required to notify me within five business days of any reinsertion. On top of that, they were supposed to get certification of accuracy from the furnisher, as required under 15 U.S.C. 1681i ( a ) ( 5 ) ( C ), and that didnt happen either. No proof, no notice. Just an unauthorized reported account suddenly showing up again. Let me be absolutely clear : I never gave written consent for this account to be reported, which means Experian is also violating the FCRA 's permissible purpose requirement under 15 U.S.C. 1681b. Reporting without consent is a serious breach of privacy and federal law. Whats worse is that this same account is being reported differently by XXXX XXXX XXXX isnt reporting this account, and no information reported, which means they verified the account as not mine, this is a violation of 15 U.S.C. 1681e ( b ) for failure to maintain maximum possible accuracy across all reports. Experians actions here are reckless. This is a case of willful and negligent noncompliance under 15 U.S.C. 1681n and 1681o, which makes them liable for damages up to {$1000.00} per violation. I already disputed this in the paper, and then they added it back. Im tired of disputing the same thing over and over again while my credit takes the hit. Im also invoking my rights under 15 U.S.C. 1681c-2, which allows me to block unauthorized reported information. Any account reported without my written consent falls under this law. Experian had every opportunity to delete this, and they didnt. Im demanding the immediate and permanent deletion of this reinserted account, or Ill be forced to escalate this legally. Please take action and hold Experian accountable. This is unacceptable.
