Subject : Formal Dispute Under FCRA regarding XXXX XXXX XXXX Account I am writing to formally dispute an account reported on my Experian credit file under the name XXXX XXXX XXXX. This account does not belong to me and is a result of theft, as supported by the following : 1. FTC Identity Theft Report 2. Local Police Report 3. Victim supplemental financial loss report. Under the Fair Credit Reporting Act ( FCRA ), specifically : 15 U.S. Code 1681c-2 ( Section 605B ) : I have the right to block the reporting of any information that results from identity theft. 15 U.S. Code 1681i : You are required to conduct a reasonable investigation of disputed information and correct or delete inaccurate, incomplete, or unverifiable data. In addition, per FCRA Section 611 ( 15 USC 1681i ) and FCRA Section 605B ( 15 USC 1681c-2 ), upon receiving proof of identity theft ( FTC report and police report ), you are required to remove or block the disputed account within 4 business days. I request that you take the following actions within 72 hours : 1. Immediately remove or block the XXXX XXXX XXXX account from my credit file. 2. Send me written confirmation of the removal. 3. Notify any third parties who accessed my credit report in the last 6 months of the correction ( per FCRA 1681i ( d ) ). Please consider this letter a formal dispute under the FCRA and a formal complaint for investigation through the CFPB if necessary.
