Consumer Narrative
I disputed complete inaccuracies on my credit report, with Experian, TransUnion and Equifax. I provided all of the documentation and proof. Experian was the first to come back and say that they verified it as accurate, despite me providing proof that it is not. XXXX has put a XXXX false collections on my credit report as " new '' collections accounts that are all in active settlement and pay back, and have been getting paid back for months. XXXX is being intentionally malicious at this point and they need to be overseen in regards to violating people 's rights. I entered into a formal payment arrangement for ( XXXX ) of the XXXX accounts with XXXX XXXX approximately XXXX months ago to resolve those XXXX debts with XXXX XXXX, and the last account is now also in active settlement. The Debt settlement company had been trying to get the final settlement agreement in place since XXXX. XXXX is weaponizing my credit report to get me to pay them faster on a settlement agreement that they initiated and signed. Their representatives were sarcastic, lacked knowledge when it came to consumers rights, and I feel they intentionally reported these other XXXX accounts as a form of retaliation as I made it very well known that I will be filing complaints for each XXXX, and disputing each one. I also made the representatives aware that they are not legally obligated to report these accounts, so if they do not report settlements ( as they state they dont ), then they should not be reporting it at all as they can not report false information, which is what they are doing. I have made all payments on time and as agreed under that arrangement. I was diligent about entering into a payment agreement with them as soon as it got into their office, to avoid negative credit reporting ( i.e. collections ). Despite complying with the agreement, XXXX reported my account to the credit bureaus as a collection account, almost 4 months later, and during the course of my repayment. This had a negative impact on my credit report. When I contacted Resurgent to ask why they reported the account as being in collections after I had already begun making agreed-upon payments, I was told that they do not report settlement agreements. However, they still reported the account as a collection, which is misleading and damaging, especially since I was actively paying under a valid agreement for almost 4 months prior to that. What was even worse, is that I was told that the only way to dispute the credit reporting accuracy, would be to terminate the payment arrangement first, which is unacceptable and appears to be an attempt to discourage me from exercising my rights under the Fair Credit Reporting Act ( FCRA ). I told them I had no desire to terminate the payment arrangement and would like to dispute the credit reporting accuracy. XXXX told me this was not possible unless I terminate my payment arrangement, which I have been successfully paying on for many months. They also told me they do not report " settlement agreements '', however, they are still required to add a note or report the status accurately. This seems like a violation of : FCRA XXXX, which prohibits reporting information that is knowingly inaccurate or misleading ; FCRA 611, which gives me the right to dispute inaccuracies ; And potentially the Fair Debt Collection Practices Act ( FDCPA ), since I am being coerced to choose between my credit rights and my payment agreement.
