Consumer Narrative
I am submitting this formal complaint to the Consumer Financial Protection Bureau ( CFPB ) regarding numerous unauthorized credit inquiries that have appeared on my credit reports with Equifax. I am the victim of identity theft, and I am requesting immediate investigation and action under the Fair Credit Reporting Act ( FCRA ) and other applicable laws. I recently reviewed my credit reports and found several hard inquiries that I did not authorize. These inquiries were made by financial institutions and companies with which I have no current or prior relationship. I have reason to believe that these inquiries are a direct result of identity theft. In accordance with 15 U.S.C. 1681c-2, I have filed an identity theft report, which includes a formal complaint and supporting documentation, such as a police report or an FTC Identity Theft Report. Under this statute, credit reporting agencies are required to block any information resulting from identity theft within XXXX ( XXXX ) business days of receiving proper documentation. Legal Violations : The following legal provisions have been violated in relation to these unauthorized credit inquiries : 15 U.S.C. 1681b ( c ) Permissible Purpose : Credit inquiries must be made only with the consumers authorization or for a legitimate business purpose. These inquiries were made without my knowledge or consent. 15 U.S.C. 1681c-1 ( a ) ( 2 ) Fraud Alerts : I have placed a fraud alert on my credit file, and creditors must take reasonable steps to verify identity before extending credit. These inquiries indicate a failure to comply. 15 U.S.C. 1681c-2 Blocking of information resulting from identity theft : The credit reporting agencies have failed to block or investigate the unauthorized inquiries despite being informed of the theft. 15 U.S.C. 1681i ( a ) ( 1 ) ( A ) Duty to reinvestigate : The credit bureaus are obligated to conduct a reinvestigation upon notice of a dispute, which they have failed to do regarding these inquiries.
