Consumer Narrative

Description of the Issue : I am filing a complaint against XXXX XXXX XXXX regarding an auto loan account ( ending in XXXX ) that has been reported inaccurately on my credit report. For the past year, I have been disputing the account with all three major credit bureaus ( XXXX, XXXX, and TransUnion ), yet the account has not been updated or removed. This is due to BMWs failure to follow consumer protection laws, including the Truth in Lending Act ( TILA ), UCC provisions, and FCRA, which required them to notify me of the loan sale and give me the opportunity to settle the after-sale balance. Timeline of Events : XX/XX/XXXX : The loan was opened with XXXX XXXX XXXX. I was the primary account holder. Date of Sale/Transfer : I have never received any written notification or documentation from XXXX XXXX XXXX regarding the sale or transfer of the loan. This violates the Truth in Lending Act ( TILA ), which requires notification within 15 days of the loan being sold or transferred. XX/XX/XXXX- XX/XX/XXXX : The loan appears to have been transferred or sold to a third-party debt collector ( according to my credit report ). However, XXXX XXXX XXXX did not notify me of the sale or provide me with the opportunity to pay off any remaining balance after the loan was transferred. Actions Taken by Me : I filed a dispute with XXXX, TransUnion, and XXXX, noting the inaccuracy of the reporting and the lack of transfer information. The account was not updated or corrected. I submitted a second dispute, specifically requesting clarification of the loans status after the sale, and asking for updates to my credit report. No action was taken by the credit bureaus or XXXX XXXX XXXX. I initiated a third dispute, again requesting removal of the account or proper updates, as it was not correctly reflecting the current status of the loan. The account still remains on my credit report without updates or corrections. I contacted XXXX XXXX XXXX directly, requesting proof of the loan sale/transfer and asking for the balance after the sale. They did not respond to my request. Actions Taken by XXXX XXXX XXXX : XXXX XXXX XXXX has failed to notify me of the sale or transfer of the loan, as required by TILA. They did not send me any written notice regarding the sale or provide me with the opportunity to pay off the after-sale balance, which I am entitled to. Despite my repeated disputes, XXXX XXXX XXXX has not updated my credit report to reflect the new creditor or the accurate status of the loan. The account remains inaccurately reported as if it were still with XXXX XXXX XXXX. Dispute Reasons : UCC 9-611 No Pre-Disposition Notice : No notification was received prior to the repossession sale, violating my rights under UCC 9-611 . UCC 9-614 & 9-616 No Post-Sale Accounting : No post-sale accounting was provided, violating the requirements under UCC 9-614 and 9-616 . FCRA 623 ( a ) ( 1 ) ( A ) Reporting Incomplete/Unverified Information : The balance of {$16000.00} is inaccurate as it was not substantiated by proper documentation, violating FCRA requirements for accurate reporting. FCRA 611 Failure to Investigate : This is my second formal dispute for this account. If a reinvestigation was conducted, it failed to address the legal deficiencies in the reporting. FDCPA 807 Misrepresentation of Debt : If this account has been placed with a collection agency, continuing to report or collect on an unverified deficiency is a violation of the Fair Debt Collection Practices Act ( FDCPA
