Consumer Narrative

Subject : Formal Complaint Regarding Account Mismanagement and Harassment To Whom It May Concern, I am writing this letter as a formal and urgent follow-up to the unresolved issues surrounding our account with Toyota Motor Credit Corporation for XXXX XXXX XXXX XXXX ( Account No. XXXX ). The ongoing lack of communication, unexplained charges, and unprofessional handling of this matter have caused serious and lasting emotional and financial stress for my family. In XXXX, we entered into a contract for 72 monthly payments of {$390.00} with interest included. I was under the impression these were made in full through XX/XX/XXXX. I, XXXX XXXX, filed for bankruptcy and legally surrendered the vehicle and all financial responsibility to my husband, who continued making the payments. Despite this, Toyota continued to send all communications to me while excluding my husband, the one actively paying. I was locked out of the online portal for a long period and only regained access after my attorney intervened. Even then, the portal showed a XXXX balance with no breakdown of payments or history. My husband had to call each month and make payments through an automated system without any visibility or confirmation. On XX/XX/XXXX, we received a Right to Cure notice claiming we were in default and owed {$880.00} immediately following what we believed to be our final payment. No prior notices were sent, and once again, the notice was addressed solely to me. When I called to seek answers, a representative named XXXX ( ID XXXX ) informed me that the balance was due to a maturity fee. This was the first time we had ever heard of such a fee. It was never mentioned in our original agreement, and no clear explanation has been provided since. I also mailed a formal letter, and my attorney reached out to Toyota. Initially, someone named XXXX responded to her, but we have received no further reply. Being told to write in again to dispute the charge, after doing exactly that and being ignored, is unacceptable. The language at the bottom of the Right to Cure notice is also highly questionable. It states : This communication is not an attempt to collect, assess, or recover a claim in violation of the Bankruptcy Code and is for informational purposes only. Then immediately follows with : This is an attempt to collect a debt and any information obtained will be used for that purpose. This is contradictory and feels like a deliberate tactic to confuse, intimidate, and pressure consumers while avoiding accountability. It creates the illusion of urgency and legal threat without proper explanation, which I believe is an abusive business practice. Adding to this, XXXX told me that I can not be removed from the title unless the vehicle is refinanced in my husbands name. However, my understanding as someone who surrendered the vehicle through bankruptcy is that I should no longer be held legally responsible and my name should not remain attached. XXXX has never provided clear documentation or guidance on this matter. Instead, they have continued to act as if I remain fully liable despite the legal surrender in XXXX. This entire ordeal has created enormous emotional and physical strain : My husband, a XXXX XXXX veteran with XXXX, was XXXX from XX/XX/XXXX to XX/XX/XXXX due to dangerously XXXX XXXX XXXX and was found to have XXXX XXXX XXXX. I received the notice while he was in the hospital. We never received any late payment warning, but this notice showed up at just the right time, which only added to the distress. I am a mother to a XXXX, struggling with XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX and XXXX, all worsened by the way Toyota has handled this situation. We are also navigating legal issues with our property management company, who continue to apply unauthorized charges to our rent account from a program we opted out of, and I am conducting an investigation into a family matter regarding my late father. Toyotas ongoing mismanagement, lack of transparency, and dismissive approach have made an already difficult time in our lives even more unbearable. This has gone far beyond poor customer service. It now feels like harassment and intimidation disguised by red tape and deliberate avoidance. Because of this, I am escalating the matter. I am in the process of filing complaints with the Tennessee Attorney Generals Office, the Consumer Financial Protection Bureau, the Federal Trade Commission, and any other applicable regulatory agencies. I will continue to document and expose every detail of how this situation has been handled. I have also contacted Legal Aid after being directed there by XXXX XXXX XXXX regarding our apartment issues. Once I hear back, I intend to raise this matter with them as well, as I believe Toyotas handling of this account may also warrant legal review. While I have not made endless phone calls due to my daily life responsibilities, I have made multiple documented attempts to resolve this including emailing Toyota directly, involving my attorney, and mailing a formal letter. Todays phone call was my attempt to gain clarity after all of that, and once again, I was met with confusion, vague explanations, and more signs of mishandling. This situation is not isolated. I have had to write countless complaints, manage back-and-forth emails, and navigate the stress of housing issues, all while caring for my child and trying to maintain my own health. It has been nonstop and extremely draining. At this point, considering all the effort Ive had to put in just to be heard, I feel like I should be on Toyotas payroll. I absolutely should not owe Toyota anything. If anything, Toyota owes me for the emotional distress, mental anguish, and undue hardship this has caused. Because honestly, this feels like an exhausting job that I am not being compensated for. This ongoing stress has affected my health, my ability to enjoy daily life, and my capacity to be fully present with my family. My son is a XXXX. He needs his mother in good health, focused, and present. And I am missing moments with him I will never get back. The impact is very real, and I will not continue to carry the weight of this mistreatment in silence. Toyotas conduct has caused serious emotional and financial harm to a military family who upheld their end of the agreement in full. There must be accountability for the way this has been handled. Sincerely, XXXX XXXX ( XXXX ) XXXX XXXX XXXX XXXX ( XXXX ) XXXX XXXX XXXX
