Since my divorce in XXXX of XXXX, I have been negotiating with my first mortgage ( Fay Servicing/ XXXX XXXX " XXXX XXXX XXXX '' ) and my second mortgage ( XXXX XXXX XXXX XXXX XXXX ) to again accept payments from me. In mid XXXX, after 10 years and dozens of Mortgage Assistance Applications, my second mortgage ( XXXX XXXX XXXX XXXX XXXX ) finally accepted a 2 % fixed mortgage payment of {$1200.00}. After I had made 3 payments to accept their offer, XXXX XXXX XXXX XXXX XXXX rescinded their offer because my first mortgage appeared on title 3 times. XXXX - XXXX XXXX XXXX refused to be in 4th position. Apparently the first mortgage had been transferred between departments using a Transfer of Deed. Typically a Transfer of Deed is accompanied by a Reconveyance which releases the interest in the property. These were never filed. Legally, I now owe Fay Servicing and XXXX XXXX 3 times the amount of my first mortgage because they fraudulently neglected to file the 2 reconveyances. I sent the attached letter in XXXX of XXXX. Instead of responding to the letter, Fay Servicing - XXXX XXXX attempted to foreclose on the property in XXXX of XXXX. I declared XXXX XXXX bankruptcy in order to stop the foreclosure. My son XXXX XXXX who is also on title declared XXXX XXXX bankruptcy in XXXX of XXXX to stop the foreclosure auction again.
