I recently received a new Loan Modification Agreement from Shellpoint Mortgage dated XX/XX/XXXX. I can not accept the terms of the agreement for the following reasons : The modification agreement shows myself and my ex wife, XXXX XXXX XXXX, as borrowers. On XX/XX/XXXX I provided documentation, via email, to XXXX XXXX ( XXXX ) to show XXXX XXXX XXXX was no longer a party to the ownership of the property or a co-borrower on the mortgage. The documents included were a Final Decree of the dissolution of the marriage, filed XX/XX/XXXX and a Quit Claim Deed, recorded in the county clerks office of XXXX XXXXXXXX XXXX XXXXXX/XX/XXXX. I later called your Loss Mitigation Department to confirm those documents had indeed been received and recorded. In addition, the Loan Modification Agreement states that the first payment is due XX/XX/XXXX. Since I only received the documents to sign and return on XX/XX/XXXX making this payment by the due date is not possible. Page XXXX of the cover letter, XXXX XXXX, states, if the payments are made after their due dates, or in amounts different from the payment amount required, your mortgage may not be eligible for this assistance. This states to me that I may already be in default of the terms of the loan and may become " ineligible for this assistance. For these reasons I request a new set of documents be created removing XXXX XXXX XXXX as a borrower and that the first payment of the new modification agreement be the first of the month following the signing and acceptance Of the new agreement. I understand the monthly payment and maturity date may be different from those stated on the agreement dated XXXX XXXX, XXXX. I will open a new complaint with the Consumer Financial Protection Bureau to address this issue and also file a complaint with my state Attorney General stating that after many months of completing the loan modification terms Including several sets of trial payment plans, Shellpoint Mortgage is negligent in providing accurate documentation and reasonable terms for the agreement.
