To Whom It May Concern, I am submitting this formal complaint and request for investigation regarding multiple inaccurate and unlawful credit reporting entries made by XXXX ( mortgage & Credit Card accounts ), DEPTED/XXXX and a medical collection agency with XXXX XXXX XXXX. These items are currently reflected on my credit reports and violate various federal consumer protection laws. I respectfully request that the CFPB take action to investigate and assist in the resolution of these matters. 1. XXXX ( mortgage and credit card accounts ) & DEPTED/XXXX Unverified Late Payments XXXX and DEPTED/XXXX have reported late payments to the credit bureaus without proper verification or due process. According to 15 U.S.C. 1666b of the Truth in Lending Act, creditors are prohibited from reporting adverse information such as late payments without first providing the consumer with an opportunity to review or dispute the charge, and without properly verifying the validity of the information. I have not received any documentation validating these reported late payments, and they were not disclosed to me during any prior billing cycles. I am requesting a full reinvestigation and immediate deletion of all late payment notations made by these institutions on my credit reports with Experian, Equifax, and TransUnion. 2. DEPTEDXXXX FERPA Violation & Student Loan Data Sharing I am also disputing the continued reporting of my federal student loan accounts by DEPTEDXXXX As a federal loan servicer, they are bound by the Family Educational Rights and Privacy Act ( FERPA ), which limits the disclosure of personally identifiable information related to education records without the student 's explicit consent. Credit reporting of these student loan records without my written authorization constitutes a violation of FERPA. Therefore, I am requesting the complete deletion of all student loan entries reported by DEPTEDXXXX from all three major credit bureaus. 3. Medical Collection with XXXX XXXX XXXX Inaccurate and Improperly Reported Debt There is a {$670.00} medical collection on my credit report related to a dental visit for my minor son. This collection is invalid and should not have been reported. At the time of service, I provided active insurance coverage with and paid my required co-pay. Over a year later, I received a phone call from the providers office stating that I had a bill due. I asked why, because he was covered under insurance. I was told that the claim had not processed due to the insurance company needing to speak with the subscriber ( my ex-husband ). The office admitted they did not notify me or follow up with the subscriber after the insurances response. As a result, I was asked to call at that time to which I stated, it's now been over a year that the claim would deny for timely filing, which is not the fault of the patient or responsible party. This is a clear case of negligent billing, not nonpayment. The account should have been resolved with the insurance provider, not shifted onto me or reported to collections. While the balance exceeds the {$500.00} threshold referenced in recent CFPB guidance issued XX/XX/year>, the debt itself remains invalid and unverified. As such, I am requesting : Immediate deletion of this medical collection from all credit bureaus A full reinvestigation from the reporting collection agency with documentation to substantiate its legitimacy Requested Action : I respectfully request the CFPBs assistance in requiring the following corrective actions from the data furnishers : Immediate removal of all unverified late payments reported by XXXX ( mortgage & cred card accounts ) and DEPTEDXXXX Complete deletion of all student loan entries reported by DEPTEDXXXX due to FERPA violations Immediate deletion of the {$670.00} medical collection account due to provider error and improper reporting If these actions are not taken, I intend to escalate this matter with additional formal complaints to the FTC, U.S. Department of Education XXXX and the Office for Civil Rights for data handling violations under federal law. Please confirm receipt of this dispute and notify me of the outcome within the timeframe prescribed under the Fair Credit Reporting Act ( FCRA ).
