Consumer Narrative
To Whom It May Concern, I am formally submitting this complaint against Experian for multiple violations of the Fair Credit Reporting Act ( FCRA ), the Fair Debt Collection Practices Act ( FDCPA ), and federal identity theft laws. Despite previous disputes, Experian has failed to correct inaccurate, unverifiable, and fraudulent information on my credit report. Additionally, I have reason to believe that Experian has allowed my personal information to be misused and compromised, which constitutes identity theft and a violation of my financial privacy rights. I initially filed a complaint with the Consumer Financial Protection Bureau ( CFPB ) last month, but it was closed without proper investigation. I am now escalating my case and attaching my FTC Identity Theft Report for further documentation. Summary of Violations 1. Misreporting Charge-Offs as Debt The IRS defines a charge-off as gross or ordinary income, not a reportable debt. Under IRS 1099-C guidelines , a charge-off must be treated as income if {$600.00} or more is canceled. Violation : FCRA 1681s-2 Reporting charge-offs as outstanding debts is unlawful. 2. Failure to Mark Disputed Accounts as Disputed FCRA 1681s-2 ( a ) ( 3 ) requires that any disputed account must be marked as such on my credit file. Experian has failed to properly mark disputed accounts, violating this requirement. 3. Illegal Re-Aging of Accounts FCRA 1681c prohibits credit bureaus from altering the date of first delinquency to extend the reporting period. I demand a full investigation into whether Experian has re-aged any disputed accounts. 4. Failure to Provide Debt Validation Under FDCPA 1692g ( a ), furnishers must provide written validation of a debt within five ( 5 ) days of reporting. I have not received such validation for the disputed debts. 5. Identity Theft and Privacy Violations Experian has allowed fraudulent accounts to be reported using my personal information, constituting violations of the following federal laws : 18 U.S.C. 1028 Fraud related to identification documents 18 U.S.C. 1029 Fraud related to access devices FCRA 1681n & 1681o Civil liability for noncompliance 15 U.S.C. 6801-6809 Gramm-Leach-Bliley Act : financial privacy protections Disputed Items on Experian Report I am formally disputing the following items on my Experian report due to inaccuracy, unverifiability, unlawful reporting, and/or identity theft : DEPT OF EDXXXX multiple accounts opened between XXXX and XXXX with late payments and incorrect high balances DEPT OF ED/XXXX XXXX XXXXXXXX opened XX/XX/XXXX late payment XXXX XXXX XXXX XXXX XXXX # XXXX late payment XXXX & XXXX XXXX Original Creditor : XXXX XXXX XXXX XXXX collection XXXX XXXX XXXX charge-off XXXX XXXX XXXX XXXXXXXX charge-off XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX ( Original Creditor : XXXX XXXX XXXX ) # XXXX collection Hard Inquiries to Be Removed These inquiries were made without my consent or permissible purpose under FCRA 1681b : XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XX/XX/XXXX DEMAND FOR RESOLUTION I am demanding that Experian : Delete the inaccurate, unverifiable, and fraudulent items listed above.
