Consumer Narrative

To Whom It May Concern, I am writing to file a formal complaint against Equifax regarding the inaccurate and misleading reporting of a collection account on my credit report. Equifax is currently reporting a collection account with a {$0.00} balance. While the balance is reported as XXXX, the account is still being listed as a derogatory collection, which continues to negatively impact my credit profile and score. This reporting is misleading, incomplete, and violates my rights under the Fair Credit Reporting Act ( FCRA ). FCRA Violation 607 ( b ) : Accuracy of Information Under the FCRA, Equifax is required to maintain and report complete and accurate information. Reporting a {$0.00} balance while still categorizing the account as an active or open collection is inaccurate and misleading. If the account is paid or no longer collectible, it should be removed if appropriate. FCRA Violation 623 ( a ) ( 2 ) : Obligation to Update Inaccurate Data If the data furnisher ( collection agency ) updated the balance to {$0.00}, Equifax is required to promptly reflect the accurate status of the account. Continued reporting as a derogatory item misrepresents the true standing of the debt. Adverse Impact Without Justification Despite the {$0.00} balance, the tradeline is still negatively affecting my credit standing. If the collection is resolved or no longer valid, its continued presence serves no legitimate purpose and only harms me unfairly. I am requesting Equifax investigate this tradeline immediately and either : Remove the account entirely and remove the negative impact if the debt never was active or collectible. I have attempted to resolve this directly with Equifax and/or the collection agency but have not received a satisfactory resolution. Therefore, I am requesting the CFPB 's assistance to ensure this matter is investigated properly and corrected in compliance with federal law. Thank you for your attention to this matter. Sincerely, XXXX XXXX XXXX Disputed Account Name : XXXX XXXX XXXX / XXXX XXXX Equifax Report Date : XX/XX/year> Please see attached credit report and paid in full notice from the original creditor with a date prior to collection activity. Meaning this account was paid off before they created a collections which makes this reporting 100 % inaccurate.
